SUMMARY OF CASE  Multiple professional corporations file several motions against the state of New Jersey.  Preliminary injunction seeking to enjoin defendants of the case.  The big issue at stake in the case is whether the 1992 Professional and Amateur Sports Protection Act (“PASPA”), which limits single- game sports betting to Nevada, is constitutional.

P.A.S.P.A  Attempts to define the legal status of sports betting throughout the United States.  This act effectively outlawed sports betting nationwide, excluding a few states.  Congress provided a one-year window of opportunity from the effective date of PASPA (January 1, 1993) for states which operated licensed casino gaming for the previous ten-year period to pass laws permitting sports wagering.

ARGUMENTS  Prevention of the encouragement of sports betting.  Gambling will lead to the tarnishing of reputations for professional sports and other organizations alike.  The way in which the consumers view the different sports will become skewed.

AFFIRMATIVE RULING  Violation of the Professional and Amateur Sports Protection Act of  State of New Jersey lacks credible reasoning for the legalization of sports betting.  Aside from potential revenue gain, the state of New Jersey may seek to find financial gain elsewhere.
