Background Tymber Skan has struggled for years – Wood-framed buildings built in – 2004 hurricanes – Foreclosure crisis – High vacancy rates – Crime 94% vacant or owned by absentee landlords Most owners have stopped paying assessments HOA has not had funds to pay bills Courts appointed receiver for 2 years
Background Orange County BCC discussions – June 3, 2014 – June 10, 2014 – August 5, 2014 Termination of water service was scheduled in early June 2014 due to unpaid bills Other services have been intermittent or not provided
Background BCC directed staff to work with OUC and receiver to develop a plan to prevent water shut-off Orange County’s scope is limited and public safety driven
Background BCC authorized expenditure of $190K for: – Board and secure vacant and abandoned units – Repair roads to allow public safety vehicles access – Work with OUC to provide water shut-off valves for each unit, repair leaks – Legal services to assist the Receiver in addressing non- paying tenants

Code Enforcement Board-ups of abandoned units Staff identified 68 open and unsecured units within 24 buildings: – Sec. 1 – 8 units in 3 buildings – Sec. 2 – 25 units in 8 buildings – Sec. 3 – 35 units in 13 buildings Board-ups completed by contractor in November at a cost of approximately $43,500 Additional units to be boarded as identified
Demolition update 2013 – 2 buildings 2014 – 1 building Early 2015 – 3 buildings pending asbestos removal Late 2015 – Up to 12 more going through hearing / notices Chapter 9 code amendments approved in Nov allow greater response to need Code Enforcement

Public Works Pavement Milling and Resurfacing of selected areas on: – Skan Court – Tymberwood Lane – Lodgewood Lane – Inglenook Lane – Barkwater Drive – Windcross Lane
Public Works Maintenance of the storm drains, pipes and outfalls are the responsibility of the HOA Poor drainage primary cause of paving failure

Utilities Sections 1 and 3 Nonpayment of utility bills to OUC was driving termination of water service Future service continuation requires: – Repayment agreement for the arrears – Residents to pay water bill directly to OUC via PowerPass – Reduce water loss Repairing leaks Terminating service to units without current accounts
Utilities Sections 1 and 3 County worked with OUC and the receiver to establish a flat water rate PowerPass program implementation – Several community meetings held – Required for Sections 1 and 3 by OUC and receiver – Majority of occupants are participating

Other Community Issues Families have received relocation assistance – 5 families relocated due to health / safety issues – 3 families assisted who couldn’t find other apartments – 4 families assisted in restoring utility service (LIHEAP)
Other Community Issues Tymber Skan Section 2 is significantly behind on water bill and at risk for termination of service Current arrears approximately $50,000 Solution would require coordination / agreements with OUC

Section 1 and 3 HOA Update Receiver has been working on a Community Business Plan Executed a repayment agreement with OUC Legal and financial challenges remain

Summary Approximately $182,200 in County funds expended On-going code enforcement activities and coordination with receiver and OUC Receiver is requesting County funds for legal assistance to stabilize revenues Long term outlook is unknown
