The United States HIV Bar Since 1987, the United States has barred HIV+ people who are not U.S citizens or residents from entering the country without a special waiver that records their status. Such a person already living in the U.S. has been barred from most types of legal status. In 1993, after President Clinton tried to end this policy, the bar was written into law by Congress. On Wednesday, July 30, 2008, President Bush signed into law the reauthorization of the President’s Emergency Plan for AIDS Relief (PEPFAR II), which included language to repeal the statutory bar.

Repealing the Statutory HIV Bar via PEPFAR II Tom Lantos and Henry J. Hyde United States Global Leadership Against HIV/AIDS, Tuberculosis, and Malaria Reauthorization Act of 2008 or Reauthorization of President’s Emergency Plan for AIDS Relief (PEPFAR II). Amends the Immigration and Naturalization Act by striking the provision that renders individuals with HIV inadmissible to the United States. Requires the Department of Health and Human Services (HHS) to reconsider whether HIV should continue to be listed as a communicable disease “of public health significance” that renders non-citizens inadmissible to the United States.

A History of Health Related Restrictions The Act of March 3, 1891 – prohibited the landing of idiots or lunatics as a medical bar to admission. The Act of February 5, 1917 – further expanded the list to include idiots, imbeciles, feeble- minded persons, alcoholics, epileptics and persons afflicted with tuberculosis or dangerous contagious disease. 1965— the U.S. Immigration Law was amended to add “sexual deviation” as a medical ground of denying entry and remained in effect until —HIV and AIDS added to a list of “dangerous, contagious diseases” that preclude non- citizens and non-green card holders from entering the U.S. 1993—HIV Bar signed into law by President Clinton.

The International Task Team on Travel and Immigration Restrictions is Formed. Advocacy Efforts to Overturn the Bar International NGOs refuse to attend San Francisco Conference. 8 th International AIDS Conference is moved from Boston, MA to Amsterdam.
