WHY THIS IS IMPORTANT FOR ME TO KNOW There are several reasons why knowing the proper procedures and how to prepare the documentation for AWOL/DFR and RMC soldiers is important. First – IT IS YOUR JOB - It is the unit’s responsibility to properly report and prepare the documentation on soldiers who go AWOL or are classified as a Deserter, and finally when they Return to Military Control. Second – Local/National authorities are notified, and can issue a warrant for the soldier, that way Civilian Authorities know to notify the Military if/when this soldier is picked up. Third – Soldiers pay is STOPPED upon absence and RESTARTED upon return. Fourth – You know the proper procedures/documentation for processing the soldier back to military control.

DEFINITIONS Definitions Extracted From AR 630-10 Absent Without Leave (AWOL): An offense in violation of Article 86, Uniform Code of Military Justice referring to a soldier who without authority — (1) Fails to go to his or her appointed place of duty at the time prescribed. (2) Goes from their place of duty without proper authority. (3) Is absent or remains absent from their unit, organization, or required place of duty. (4) Fails to report to a transportation terminal as ordered. (5) Fails to report to his or her proper duty station as ordered.

DEFINITIONS (CONT) Deserter : A soldier dropped from the rolls of his or her unit when — (1) Absent without authority for 30 consecutive days. (2) The unit commander believes the soldier voluntarily sought political asylum or is living in a foreign country apart from official duties or authorized leave. (3) The soldier has joined the armed forces of a foreign country. (4) There is reasonable belief that the soldier has left his or her duty station with the intent to avoid hazardous duty or important service, or intends to remain permanently absent. An expressed intention not to return to a particular unit is not enough evidence to drop the soldier from the rolls of the Army. (5) The soldier fails to return to a unit from which he or she is AWOL after RMC at another location or departs prior to the completion of administrative, judicial, or non judicial action for a previous absence. (6) He or she escapes from confinement. (7) Identified as a special category absentee. (8) A commissioned officer tenders his or her resignation and before notice of its acceptance, departs their post or proper duties without leave and with the intent to remain away permanently. (9) A member of the Armed Forces goes from or remains absent from his or her unit, organization, or place of duty with intent to remain away permanently. (A violation of Article 85, UCMJ .)

ABSENT WITHOUT LEAVE (AWOL) PROCEDURES Step 1. PAC submits eMILPO transaction for duty status change. Step 2. PAC submits to the Provost Marshall a DA Form 4187 for a duty status change within 24 hours of soldier being AWOL. Step 3. PAC submits to the 3d SSB Personnel and Finance this MP stamped DA Form 4187 within 48 hours of soldier being AWOL. Step 4. Verify IAW DA PAM 600-8, 9-12, table 9-1-1 for duty status change (Section II, DA From 4187), DA PAM 600-8, 9-12 procedure 9-8 steps 1-23. AR 190-9, AR 630-10, DA PAM 600-8, Table 9-1-1

DROPPED FROM ROLLS (DFR) PROCEDURES Step 1 PAC/Unit commander verifies soldier duty status i.e. (DFR) Step 2 Notify local Provost Marshal within 24 hours by providing the DA Form 4187 AWOL to DFR and DD Form 553 (Desertee/Absentee Information Sheet) Step 3 Submit to AWOL/DFR Section the DD Form 458 Charge Sheet, the MP-stamped DA 4187 and DD 553 within 48 hours of desertion date. Step 4 AWOL/DFR Section Submits Dropped From Rolls Transaction. Step 5 If the soldier has access to classified material (i.e. security clearance), report thru your S2 and get memo for DFR packet Step 6 Complete rest of Dropped From Rolls Packet within 20 days of the DFR Date, and submit to AWOL/DFR Section. Step 7 AWOL/DFR Section forwards DFR packet to USADIP.

DA Form 4187 - Assigning the soldier from “AWOL” to “DFR” (To PMO Within 24 Hours, To AWOL/DFR Section Within 48 Hours) 3. DD Form 553 - Deserter/Absentee Wanted by the Armed Forces (To PMO Within 24 Hours, To AWOL/DFR Section Within 48 Hours) 4. DD Form 458 - Charge Sheet Note: The Original Copies Of These Documents Must Be Submitted To The AWOL/DFR Section.

RETURN FROM AWOL/DFR PROCEDURES Step 1. PAC submits to the Provost Marshall a DA Form 4187 for a duty status change within 24 hours of soldier being PDY (present for duty). NOTE: If soldier was DFR, returnee must be escorted to the MP station. Step 2. Bring stamped DA 4187/RMC Checklist to AWOL/DFR section. NOTE: If soldier was DFR, returnee must be escorted to the AWOL/DFR Section. THE FOLLOWING STEPS ARE FOR DESERTERS RETURNED TO MILITARY CONTROL ONLY. Step 3. AWOL/DFR Section processes soldier back into system. Return From DFR Transaction DD 93 And SGLI Updated DA 1506, Statement of Service, Prepared Step 4. Returnee Goes To Post Retention For ETS Update. WHAT HAPPENS WHEN A SOLDIER DOESN’T RETURN LET’S SAY THAT YOU HAVE A SOLDIER WHO DESERTED AND YOU HAVE SUBMITTED A COMPLETE DFR PACKET ON THIS SOLDIER. THE SOLDIER THEN IS EITHER APPREHENDED BY CIVILIAN OR MILITARY AUTHORITIES OR TURNS THEIRSELF IN AT ANOTHER INSTALLATION. ONCE THIS HAPPENS, USADIP WILL PREPARE A DD FORM 616 AND A USADIP FORM 225-R. THESE FORMS WILL LIST THE DATE/TIME, LOCATION, AND CIRCUMSTANCES REGARDING THIS SOLDIERS RETURN TO MILITARY CONTROL. USADIP WILL THEN FORWARD THE PACKET BACK TO THE LOSING INSTALLATION. UPON RECEIPT OF THE PACKET BACK FROM USADIP, THE AWOL/DFR SECTION WILL CONTACT THE UNIT TO INFORM THEM THAT THE SOLDIER HAS BEEN RETURNED TO MILITARY CONTROL, AND DO A RETURN FROM DFR TRANSACTION IN eMILPO. IF THE SOLDIER HAS NOT YET RETURNED TO THE UNIT, IT IS THE UNIT’S RESPONSIBILITY TO INVESTIGATE WHY THIS SOLDIER HAS NOT YET RETURNED TO THE UNIT. IF IT IS FOUND OUT THAT THE SOLDIER WAS ISSUED A PROVISIONAL PASS (DD FORM 460) AND A TICKET TO RETURN TO THE INSTALLATION THE SOLDIER DESERTED FROM, THE UNIT MUST PREPARE A NEW PACKET ON THE SOLDIER.

WHAT HAPPENS WHEN A SOLDIER DOESN’T RETURN THIS PACKET WILL CONSIST OF THE FOLLOWING DOCUMENTS. DA 4187 PLACING THE SOLDIER FROM DFR TO EITHER CONFINED CIVILIAN AUTHOURITY (CCA) OR CONFINED MILITARY AUTHOURITY (CMA) EFFECTIVE THE DATE/TIME THE SOLDIER WAS APPREHENDED OR TURNED THEMSELVES IN. DA 4187 PLACING THE SOLDIER FROM EITHER CCA OR CMA TO AWOL EFFECTIVE THE DATE/TIME THE SOLDIER WAS ISSUED THE PROVISIONAL PASS. DA 4187 PLACING THE SOLDIER FROM AWOL TO DFR EFFECTIVE 24 HOURS AFTER PLACING THE SOLDIER AWOL. DD 458 DD 553 THIS PACKET IS THEN TAKEN TO THE PMO FOR STAMP AND TURNED IN TO THE AWOL/DFR SECTION. THE AWOL/DFR SECTION WILL THEN SUBMIT A NEW DROPPED FROM ROLLS TRANSACTION IN eMILPO, AND RESUBMIT THE PACKET TO USADIP.

WHAT HAPPENS WHEN A SOLDIER DOESN’T RETURN IF THE UNIT INVESTIGATION REVEALS THAT THE SOLDIER IS STILL BEING DETAINED OR IS RESTRICTED TO THE AREA WHERE THE SOLDIER WAS EITHER APPREHENDED OR TURNED HIMSELF IN, THE UNIT NEEDS TO FIND OUT HOW LONG THIS WILL BE. IF THE CONFINEMENT OR RESTRICTION IS FOR LESS THAN SIX MONTHS, THE SOLDIER WILL REMAIN ON THE UNITS BOOKS IN A CONFINED STATUS UNTIL THE SOLDIER’S CONFINEMENT/RESTRICTION IS COMPLETE AND THE SOLDIER RETURNS TO THE UNIT. IF THE CONFINEMENT IS FOR MORE THAN SIX MONTHS, THE UNIT HAS A FEW OPTIONS. THE UNIT CAN HAVE THE SOLDIER REASSIGNED TO THE NEAREST PERSONNEL CONTROL FACILITY (PCF) IN THE SOLDIERS AREA OF CONFINEMENT. IF THE SOLDIER IS RESTRICTED, THE SOLDIER IS ATTACHED TO A UNIT IN THE SAME GEOGRAPHICAL AREA. THE PARENT UNIT CAN INITIATE CHAPTER PROCEEDINGS. REFER TO AR 630-10 CHAPTER 2 PARA 5 AND CHAPTER 4 PARA 12 TO DETERMINE WHICH OPTION BEST SUITS THE SOLDIERS CASE. WHATEVER THE FINAL DISPOSITION, A COPY OF THE DOCUMENTATION MUST BE SUBMITTED TO THE AWOL/DFR SECTION.
