FERPA is a Federal Statute enacted in 1974 Compliance is required by all Public Schools by the US Department of Education Failure to comply with standards could result in the loss of all Federal Funding to institution All students who attend the Citadel have FERPA rights

FOR TRAINING USE ONLY Why FERPA is Important Blatant violation of FERPA rights could hurt the school financially (through loss of federal funding and law suits) FERPA rights violations can create grounds for an appeal resulting in honor violators staying at our school 11

FOR TRAINING USE ONLY Appeals Process Why are there cadets on campus who have been found in-violation of the Honor Code? Cadets who appeal a guilty verdict remain in good standing with the college until their Honor board of Review scrutinizes the appeal. If sufficient grounds are found for an appeal, the board will review the entire case and make a recommendation to the President to either affirm or overturn the Honor Court’s ruling President considers appeal and recommendation and makes the final decision 12

FOR TRAINING USE ONLY How the Appeals Process works When an accused cadet is found in-violation of the Honor Code three options are given to him/her: –Accept the finding and expulsion –Resign from the College: transcript will read “Permitted to Resign” –Appeal 13

FOR TRAINING USE ONLY Grounds for Appeal New evidence, available since the Honor Court hearing, which would indicate the findings of the court are in error Evidence that the cadet’s rights were not protected, jeopardizing that cadet’s right to fair and impartial hearing (FERPA) An error in the trial proceedings of such magnitude as to jeopardize the fairness of the hearing 14

FOR TRAINING USE ONLY Changes to Punishment System Your signature on punishment sheets signifies that you served the punishment correctly. Signing for a punishment that was not served correctly constitutes lying! It is the weekend duty team’s responsibility to oversee punishments by: 1.holding formations hourly in front of the letter for those serving cons, to take accountability and inspect uniforms 2.Checking rooms of those serving cons at least once every hour Even though it is the duty team’s responsibility to oversee punishments, you are still responsible for your conduct. 20

FOR TRAINING USE ONLY Changes to Punishment System The regulations regarding the proper serving of a punishment have been added to the top of the punishment sheets to avoid confusion. The improper punishment pull has been removed from the blue book. Failure to serve a punishment will result in a loss of credit, but no additional punishments will be added. For further information see reference the blue book or your company honor rep. 21

FOR TRAINING USE ONLY Cons The Blue Book reads as follows: A confinement is a 50 ‑ minute period during which confined cadets, in duty uniform with white waist belt, are required to remain in their room, which is maintained in MRI Order. At the beginning of the first confinement period, and after each confinement served, each confined cadet reports to the formation at the base of the company letter to be inspected. At the end of the period, the cadet signs the confinement sheet. A cadet’s signature on the confinement sheet indicates understanding of confinement’s status and that he/she was sitting punishment in their room during the previous confinement period, unless excused by a proper authority. Confined cadets are not authorized visitors and will display CC Form 15 on their door which says “CONFINEMENT.”The form is available at: administration/commandant-administration-cc-forms.52http:// Confinements are served on Wednesday at 1500, 1600, and 1700; on Friday at 1900, 2000, and 2100; and on Saturday at 1400, 1500, 1600, 1900, 2000, and Optional Sunday 1400, 1500, 1600, and 1700 is available for in season Corps Squad cadets. The maximum number of confinements served per week is 12 confinements (or 12 punishments). During each confinement period, a weekend duty team member will check the room of the confined cadets at least once to ensure that confinements are being served. In the case of a confinement being improperly served, the weekend duty team member may make a spot correction or mark NC (no credit) on the confinement’s sheet. NC- Should the cadet fail to serve punishment, the cadet’s punishment slot should be marked NC, and he/she may receive a performance report. 22

A tour is a 50- minute period of time during which a cadet marches on the quadrangle at 120 steps a minute with a rifle at right or left shoulder arms. 2. The cadet marches in duty uniform with white waist belt and white gloves with no name tag. 3. NO electronic devices, tobacco products, or other items that prevent a cadet from strictly marching a tour are allowed. 4. prior to the beginning of the first tour period, each cadet with tours reports to the company duty team in front of the company letter to be inspected for proper uniform. 5. After the tour period is completed, cadets will sign the tour sheets located with the Battalion Duty or Guard Team. 6. A cadet’s signature on the tour sheet indicates understanding of completing a proper tour and that he/she completed a tour during the previous tour period, unless excused by proper authority. 7. Cadets having both tours and confinements must walk tours first. 8. No other activities are allowed on the quad during tours are being walked, including crossing the quad by class privilege unless on Guard Duty. 9. NC- Should the cadet fail to serve punishment, the cadet’s punishment slot should be marked NC, and he/she may receive a performance report. 10.
