Background Before Incorporation Flagler County collects impact fee for entire county After Incorporation City – County Interlocal Agreement September 29, 2000 City collects transportation impact fees as part of the building permit process beginning on October 2, 2000 September 21, City Adopts Transportation Impact Fee Ordinance

Background Prior to 2000 Interlocal Agreement Flagler County collects impact fees countywide Two impact fee districts All County lands east of FEC railroad and all county lands west of FEC railroad

Background After Incorporation of City of Palm Coast Three impact fee districts: District 1 – all lands within corporate limits of City of Palm Coast District 2 – all lands east of FEC-RR except within City of Palm Coast District 3 – all lands west of FEC-RR except within City of Palm Coast

Background May City and County joint workshop to discuss the use of the impact fees Workshop led to an agreement to coordinate efforts on the timing and completion of the transportation projects collectively known as the Northeast Palm Coast Corridor Projects.

Background Progress to completing the projects: City and County worked with the Florida Department of Transportation (FDOT) to fully fund the construction of the Matanzas Woods Parkway/I-95 Interchange, Executed ILAs between City and County to fund design of the Old Kings Road Extension with County to administer the design phase, Land acquisition for floodplain compensation & Right of Way for Palm Harbor Extension – (est. closing date by end of July), The proposed ILA is a continuation of the coordination of efforts between the City and County to complete the Northeast Palm Coast Corridor projects

Interlocal Agreement-Details Amount – Approximately $3.5 million (Agreement will close the County impact fee fund with a $0 balance at completion of projects) Availability of funds: $1.5 million immediately after execution of ILA, $1.5 million after reimbursement of wetland mitigation costs from FDOT (County will apply for reimbursement no later than 45 days after payment of wetland mitigation credits), Remaining balance of about $500,000, to be utilized temporarily by County to cover costs associated with project and fiscal management of the design phase of the Old Kings Road extension project, Remaining balance becomes available upon receipt of the final reimbursement payment from the FDOT for the design phase of the Old Kings Road extension project.

Interlocal Agreement-Details Other properties – City acquisition

Interlocal Agreement-Details Jurisdiction and maintenance responsibility includes, stormwater, mitigated/protected wetlands, conservation easements, trails/sidewalks, and any floodplain or other regulatory agency requirements related to the roadways. The City will accept those lands with existing and past mitigation requirements after successful criteria have been found acceptable by the applicable agency. The City shall be required to permanently waive or provide credits against any current or future stormwater fees or other City assessments for the parcels retained by the County.

Interlocal Agreement-Details Restrictions prohibiting the sale or transfer of any property granted for transportation purposes without the County’s written approval and requiring the proceeds of any approved sale or transfer be paid to the County; Additionally, lease fees or other revenues generated on any property transferred by the County to the City shall be required to be provided to the County. To complete the Matanzas Woods Parkway Interchange project, the City shall within sixty (60) days of the Effective Date of this Agreement, provide the additional land needed for floodplain compensation caused by the impacts created by the Interchange improvements. (8.317 acres purchased by City for $71,000)
