Fair Credit Reporting Act Changes in the FCRA Effective date: Purpose: Investigative Consumer Report Before hiring, retaining, or promoting: Adverse action: Indemnification: Compliance: Web site: September 30, 1997; Revised November, 1998 To protect consumers (job candidates), the FCRA places new requirements on employers who use “investigative consumer reports” (background reports) to determine action for hiring, retention, and/or promotion. The FCRA has defined an “investigative consumer report” as a report containing criminal history, motor vehicle history, employment references, etc., as well as a candidate’s credit history. Prior to conducting any type of background investigation, employers are required to obtain a signed applicant release from the candidate authorizing the investigation. The FCRA requires that the applicant release must be separate from the job application. If the employer decides not to hire, promote, or retain a candidate as a result of a background report (in part or in whole), the following steps must be taken: First, a “summary” of the candidate’s rights under the FCRA and a copy of the background report must be provided to the candidate. Then, an “adverse action” letter must be provided to the candidate, explaining that, as a result of the background report, adverse action is being taken. The employer performing background checks, the consumer reporting agency, and all previous employers reporting references are now, by Federal Law, indemnified from prosecution as a result of performing background checks except in intentional cases of slander. Employers must provide written agreement to the consumer reporting agency (background checking company) that they will comply with all regulations of the FCRA.
