Introduction This is the presentation of the Department of Social Development(The DSD) The presentation attempts to respond to all issues raised during the public hearings, by summing up similar issues and providing broad responses to the concerns raised. The presentation will provide information about the DSD programmes for people with disabilities and their current status , whilst in the process provide information that would respond to the concerns raised.

Background Constitutional mandate The DSD derives its core mandate from the Constitution of the Republic of South Africa, 1996 (Act No. 108 of 1996). Section 27 (1) (c) of the Constitution provides for the right of access to appropriate social assistance to those unable to support themselves and their dependants. Also Section 28 (1) of the Constitution sets out the rights of children with regard to appropriate care, basic nutrition, shelter, healthcare and social services, and detention, Welfare services, population development, and disaster management are identified as functional areas of concurrent national and provincial legislative competence

Background The programme is aligned and responds to the following government Strategic outcomes: Sustainable human settlement and improved quality of household life An efficient, effective and development oriented public service and empowered ,fair and inclusive citizenship All people in South Africa are and feel safe

Background The programme is aligned and responds to the DSD outcome of improved quality of household life & strives to protect and promote the rights of people with disabilities The target group of the DSD are the poor, marginalised and vulnerable groups in society, of which persons with disability forms an integral part Services are provided within three main developmental social services - Social Security, Social Welfare and Community Development. National DSD is tasked with development of policies & service delivery takes place at provincial level The programme serves as disability focal point in the DSD es

Background In terms of Institutional Arrangements,the programme is located as a directorate within the Welfare Services branch, with the similar structure replicated at provincial level

Legislation & Policy framework The Constitution of the Republic of South Africa, 1996 (Act No. 108 of 1996) The Convention on the Rights of Persons with Disabilities Children’s Act DSD developed a wide range of disability policies, guidelines and strategies relating to the specific services it provides to people with disabilities, viz: - Policy on the provision of Social Services to people with disabilities, - Community Based Rehabilitation Guidelines, - Guidelines on Residential Facilities,

Policy framework - Guidelines on Protective workshops, - HR Strategy on Disability, - Strategy towards Integrated Services to Children with Disabilities DSD aligned its Policy, Guidelines & Strategies to the Convention The Policy provides an overarching framework on the DSD’s approach to, and implementation of services to people with disabilities. It serves as the framework for any legislation that may be required to give effect to this policy It is cognisant of the roles and responsibilities of various role-players from all sectors of society, in delivering mainstreamed social development services to people with disabilities The M&E indicators in this policy serve to provide the data against which South Africa can measure whether it is indeed meeting the social development services needs of people with disabilities.

Delivery of services Policies are implemented at provincial level in partnership with NGOs/CBOs/DPOs, funding & support to the organisations is provided both at national & provincial level. Core programmes rendered to people with disabilities programme include the following: Services to Children with disabilities Residential facilities for people with disabilities Protective workshops for people with disabilities Social Rehabilitation services for people with disabilities Disability mainstreaming services – to ensure integrated services-e.g. Services to children, Families etc

Delivery of services Wide consultation with the broader disability sector, parent organisation, government officials was ensured in the development of the policies /guidelines. Training on all policies/guidelines and strategies was facilitated with all relevant stakeholders including people with disabilities.

Services to Children with Disabilities The DSD developed the Strategy towards the Integration of Children with Disabilities, aimed at guiding service provision to ensure inclusive programmes. It was widely consulted - with stakeholders from national and provincial as well as with other government, parents organisations and the disability sector. It is inclusive of programmes and services such as Early Childhood Development, Basic Education, Health, Sports and Recreation and Justice

Services to Children with Disabilities Broader disability sector, inclusive of NGOs, parents organisations, & children participated in the development of: Inter & intra-departmental collaboration and advocacy for effective mainstreaming of children with disabilities in the implementation of the Children’s Act National Policy Framework for Children Guidelines on norms and standards Implementation plan and costing model for child abuse neglect and exploitation Strategy on child headed house hold (CHH) Early childhood development and partial care services

Services to Children with Disabilities To ensure the development of a base line to guide the implementation of the strategy, a situational analysis of children with disabilities(on the provision of services) was conducted in partnership with UNICEF, DOE, DOH & DWCPD. The research involved participation of national and provincial departments, organisations for people with disabilities, non-governmental organisations in workshops and focus groups

Residential facilities DSD supports 149 facilities spread across the country with majority locate din urban settings of provinces. To guide service delivery in those facilities, DSD developed policy guidelines, minimum norms and standards, drafted protocol guidelines and audited facilities to determine the level of compliance with the DSD prescripts. Facilities implement a number of services depending on their beneficiaries. Most facilities have protective workshops

Social Rehabilitation & Social Work Services Rehabilitation centres offer rehabilitation services to people with disabilities in order to decrease the impact of disability and promote independence and full participation in society. Services provided include: the promotion of independence in personal care skills vocational rehabilitation recreational activities family and carer training the facilitation of general re-integration into society Assessment for the prescription and/or provision of mobility and other assistive devices wheelchair maintenance and repair specialised clinics on-site work/home assessments

Protective workshops The DSD supports 293 protective workshops, established to provide socio-economic activity-based production of goods, which are done at a small scale. They are run and managed by NGOs.The activities offer a basis for the applied and practical therapeutic services for people with mental disabilities, intellectual and other disabilities

Social Security Social Security provides protection aimed at providing financial assistance (in a form of grants) to vulnerable people, including people with disabilities. Funding of NGOs Over the years the DSD had a number of interactions with the broader National and Provincial NGOs sector which provided insight & understanding into the Ngo environment & challenges. Ministerial platforms were held which prompted the national NPO summit held on the 14-17 August Concerns raised resonated around: Partnerships Adequate funding Service delivery Legislative framework

Disability Mainstreaming The programme remains the disability focal point for the DSD – responsible for disability mainstreaming in the national & provincial DSD Programme managers are assigned different programmes to guide and work with for development of policies, norms & standards, strategies etc, to ensure inclusive and responsive programmes(e.g– HIV&AIDS, Children, Substance abuse, Gender, Families, Community dev etc.) The following activities were undertaken following the ratification of the UN Convention: - Auditing of DSD policies and programmes to determine their alignment to the convention

Disability Mainstreaming Conducted capacity building workshops for senior managers and middle managers in all DSD departments Facilitated the development of an HR strategy on disability & a disability mainstreaming toolkit to enhance the development of disability related planning & inclusive programmes Established partnership with a Japanese funder (JICA) who donated 10 wheelchair accessible minibuses to the DSD Planned training of DSD officials(Management, decision makers and practioners)on disability related planning, disability related budgeting, & generic social work training)

Way Forward Improvement of partnerships and funding of NGOs to respond to the needs of people with disabilities Ensuring disability representation within the different Social Services professions to enable the DSD to respond to the 2% disability equity target, integration of disability within the DSD programmes & complement the scarcity of Social Workers in the DSD programmes. Enhance our partnership with key national departments so as to continuously improve service delivery to people with disabilities. THANK YOU !
