2 Is it illegal or unsuitable? For a child of 14 years old to send a ‘sexy picture’ of themself to their boyfriend or girlfriend?

3 Is it illegal or unsuitable? illegal – under the Protection of Children Act 1978 and the Criminal Justice Act 1988; two offences will have been committed. By causing or taking an indecent image or photograph, having it in their possession and or distributing an indecent image or photograph of a child. This could attract a prison sentence of up to 15 years and/or being registered on the Sex Offenders Register for life!

5 Is it illegal or unsuitable? illegal – under the Fraud Act 2006 possessing or having under your control any article for use in, or in connection with any fraud, for example, possession of computer files that could launch a 'phishing' attack carries a maximum sentence of 5 years imprisonment. Under the Safeguarding Vulnerable Groups Act 2006, it could also be looked as financial or material abuse, which includes theft, fraud, exploitation, or pressure in connection with the misuse or misappropriation of, property, possessions or benefits where it relates to a vulnerable adult.

7 Is it illegal or unsuitable? unsuitable - as at present there is nothing to suggest that there is any intention to commit an illegal act or intention of sexual grooming. Questions might be asked why a 32 year old man may be pretending to be 15 years old and would require monitoring. Encouraging the child to discuss any concerns they might have with you or pointing out they can access the CEOP report abuse button if they start to feel uncomfortable, would be a way of helping to make their use of the internet safer.

9 Is it illegal or unsuitable? illegal - a person commits an offence if a person aged 18 or over has met or communicated with another person under 16 years old (the child) on at least two occasions, and subsequently intentionally meets or travels with the intention of meeting with the child, with the intention of involving the child in sexual activity.

11 Is it illegal or unsuitable? illegal - under the malicious Communications Act 1988/2003; a person is guilty of an offence if he/she sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character. You could be charged under the Public Order Act 1986 if you use threatening, abusive or insulting words or behaviour, within the hearing or sight of a person likely to cause harassment, alarm or distress.
