E-Plan Web-Based Tier II Reporting System Emergency Planning and Community Right-to-Know Act (EPCRA)

Title III Legal References  The Superfund Amendment and Reauthorization Act (SARA) was signed into law by President Reagan in 1986 as a revision to federal legislation dealing with hazardous substances and toxic wastes. SARA Title III, known as the Emergency Planning and Community Right to Know Act (EPCRA), required the development of a State Emergency Response Commission (SERC) as well as Local Emergency Planning Committees (LEPCs) to manage hazardous materials preparedness at the State and county level.  In addition to State and local planning requirements, EPCRA Section 312 requires facilities that use or store a hazardous chemical above a threshold quantity to annually submit their chemical inventory information to off-site officials on or before March 1st of each year. The inventory information must be submitted to the fire department having jurisdiction over the facility, the respective county LEPC, and the SERC.

Title III Legal References  EPCRA Section 313 (commonly referred to as the Toxic Release Inventory or TRI) requires facilities to complete a Toxic Chemical Release Inventory Form annually for specified chemicals. The form must be submitted to EPA and the State on July 1 and cover releases and other waste management of toxic chemicals that occurred during the preceding calendar year.

Tier II Reporting Procedure  Tier II reports that have been previously required in paper form will now be accepted by an electronic process called E-Plan.  Paper will still be accepted for the 2009 reporting year.

E-Plan What is it?  An initiative developed for EPA Region VI  Developed as Joint Program between The University of Texas at DallasThe University of Texas at Dallas Environmental Protection AgencyEnvironmental Protection Agency Department of Homeland SecurityDepartment of Homeland Security  E-Plan is a highly secure web-based system for receiving chemical information to the State.

E-Plan What is it?  E-Plan is a proven system that provides First Responders and others with on-site hazardous chemical information for fixed facilities around the United States.  erplan.net  E-Plan online training website  eplan.erplan.net/training/

 It is free, simple and easy for First Responders and State and Federal users to use.  E-plan operations run 24 hours a day, 7 days a week. E-Plan What is it?

E-Plan How does it work?  First Responders access facility information through a secure login using an assigned “User ID” and “Password.”

E-Plan How does it work?  Once logged on, the First Responders have immediate access to all Hazmat information for all facilities in the selected E-Plan area.

E-Plan How does it work?  This includes information from sources such as:  State Tier II information  MSDS, Chemical Profiles, ERGs  Facility/Building Maps (if available)  Chemical storage locations  Pertinent Web links  EPA, Cameo, GIS Mapping, RRT6, NRT, EPA’s CEPPO, Weather, etc.

E-Plan User Account Approval Process  Agree to E-Plan Acceptable Use Policy  Approval by Local Authorizing Authority  Approval by E-Plan Administration  Individual User ID’s and Password
