BCEHFP Regulatory Updates Part 14 Food Protection - Consolidate all current subparts by adopting Chapters one through seven (technical content) of the U.S. Food and Drug Administration (FDA) Model Food Code. Modernize Part 14 which was last amended in 1997 will provide consistency with national standards. Promote uniformity within NYS with National standards.

BCEHFP Regulatory Updates 72-1 Tanning Facilities Amending to be consistent with recent amendments to Public Health Law Article 35-A –Tanning Facilities concerning minimum age requirements (17 years of age). Additionally, the proposed amendments will clarify a LHD’s authority to implement all aspects of the program. When the regulation is signed by the Commissioner, it will be included in the State Register as a consensus regulation and undergo a 45 day comment period. If no substantive comments are received it will be approved and published in the State Register. Currently 20 local health departments have received PIO delegations.

BCEHFP Regulatory Updates Proposed Subpart 72-2 Body Art Body Piercing and Tattooing – Amend to be consistent with Public Health Law Article 4-A – Regulation of Body Piercing and Tattooing. The regulations will provide definitions and requirements for permit, inspection, and operation of tattooing facilities and the licensing of tattoo artists. Draft regulations will be sent to you for comment.

BCEHFP Regulatory Updates Subpart 7-2 Children’s Camps Justice Center Regulations - addresses the requirements of Chapter Law which established the New York State Justice Center for the Protection of People with Special Needs (Justice Center). Designed to strengthen and standardize the safety of vulnerable people that receive care from New York’s Human Services Agencies and Programs. Includes children’s camps for children with developmental disabilities as a type of facility within the oversight of the Justice Center. Required the Department to promulgate regulations approved by the Justice Center pertaining to staff hiring, staff training and incident management.

NYS Justice Center On December 17, 2012, the New York State Justice Center for the Protection of People with Special Needs (Justice Center) was established through legislation in order to strengthen and standardize the safety net for vulnerable people that receive care from New York’s Human Services Agencies and Programs.

NYS Justice Center The legislation identifies children’s camps for children with developmental disabilities to be within the oversight of the Justice Center. It requires the Department of Health to promulgate regulations approved by the Justice Center pertaining to staffing requirements and incident management.

NYS Justice Center Subpart 7-2 amendments for children’s camps with 20% or more children with DDs New staff screening requirements. –Camps must verify that staff is not on the Justice Center staff exclusion list (SEL). Camps have been asked to submit a form to the Justice Center to designate and authorize a person to check the Justice Center SEL. –Camps are also required to check the OCFS State Central Registry of Child Abuse and Maltreatment

NYS Justice Center Subpart 7-2 amendments for camps that have 20% or more children with a DD. New staff training requirements. –Staff are now required to obtain mandated reporter training and report abuse, neglect and other significant incidents to the Justice Center vulnerable person’s central registry and to the local health department.

NYS Justice Center Amendments - Incident Management Camps are required to cooperate fully with reportable incident investigations and provide/disclose all necessary information and access to conduct investigations. Unless a waiver has been granted, camps must convene a Facility Incident Review Panel to review the camp's responses to a reportable incident.

NYS Justice Center How many camps will be impacted by the amendments? There are between 40 and 50 camps with 20% or more children with development disabilities. (A list of DD camps provided to regional offices are being verified by LHDs) When will the amendments become effective? The amendments will be effective this camp season.
