Michigan’s Custody & Parenting Time Acts Friend of the Court Act ( ) Child Custody Act ( ) Support and Parenting Time Enforcement Act ( ) Paternity Act ( ) Family Support Act ( )

Friend of the Court Act Requires the Friend of the Court to investigate and make written recommendations regarding custody and/or parenting time Requires the Friend of the Court to initiate enforcement if a written complaint is made Requires the Friend of the Court to provide alternative dispute resolution to assist parties in settling disputes voluntarily

Child Custody Act Best interests of the child Presumed to be in the best interest of the child for the child to have a strong relationship with both parents

Support and Parenting Time Enforcement Act Provisions for enforcing parenting time order violations Enforced against either parent Remedies include – Make up parenting time – Commitment to county jail – License Suspension – Fines

Paternity/Family Support Act Provisions for custody and parenting time and referral to Friend of the Court

Parenting time disputes Statewide computer system allows for enforcement against either parent ADR varies by county

Parenting Time and Michigan’s Child Support Formula The number of overnights with each parent is part of the formula Parenting time has been part of the support calculation since 2008 Prior to 2008 there was a support abatement after a set number of overnights; usually 50% after 7 consecutive overnights
