WHO IS THE REAL PIRATE? Kyler Branaum

WHERE IT ALL BEGAN Remember Napster? The time before the RIAA charged Napster with Copyright Infringement. Download all the music that you wanted for free. Feb 12, 2001 was the end  Other P2P Software arose from the ashes.  Kazaa, Morpheus and Grokster  They were all the same thing, except for one minor tweak.

SOME STATISTICS  Over 42% of the World participates in illegal downloading.  12.5 Billion economic loses in the music industry  71k jobs lost the U.S alone  The average IPod has a song value of $800

WHY?THE EXCUSES..  Over 70% of people think that there is nothing wrong with downloading material.  Too expensive?  Just because I can…  It is easy to do  The product is not worth the price..  1 st amendment  It’s not hurting anyone  Just “trying it out” before I buy

REALITY HITS HARD  1 st amendment protects freedom of speech and expression, NOT piracy.  Newton's 3 rd Law: For every action is an equal and opposite reaction.  Too expensive? Or the Product is not worth the price?(agreed)  RIAA doesn’t forgive at all  Supreme Court doesn’t care

CONSEQUENCES  2004, Joel Tenebaum was convicted of illegally downloading and sharing 30 songs.  Charged with a $675,000 fine  4 years of appeals(failed)  2006, Jammie Thomas was convicted of sharing music on Kazaa(24 songs)  Charged with $220,000  2 year appeal process ended in failure.

A DIFFERENT APPROACH TO THE WAR

IS THIS ETHICAL OR NOT?  The million dollar question split up..  Is everyone who downloads, bad?  The convictions?  Who is really to blame?

QUESTIONS?????
