What Is Copyright? Copyright is protection provided by law to the authors or creators under title 17 Copyright is offered for all original works when they are created ▫Whether they are published or unpublished

Unprotected Materials The Copyright has expired It is donated to the public Has not been notated or recorded ▫such as spontaneous dances or speeches Any titles, names, short phrases, slogans, lettering, or coloring Any Ideas, procedures, concepts, or discoveries

Fair Use Allows limited use of copyrighted material without permission from the owner ▫Must be used for educational purposes Need 4 factors to qualify for Fair Use: 1.The purpose of the use 2.The nature of the copyrighted work 3.The amount intended to be used 4.The effect of the use on the market

Purpose of the Use Proposed use is for nonprofit and educational ▫Not for commercial use Nature of the Copyrighted Work If the work used is factual not a creative expression ▫Does not apply to works such as standardized tests or workbooks

Amount of the Portion Used The quality and quantity of the portion taken ▫The more of the original taken, the less likely it follows Fair Use Effect of the Use on the Market If the use is unlikely to be widespread or used to negatively affect the market
