The Facts about MSDS Sheets What is a Material Safety Data Sheet? Provides both workers and emergency personnel with the proper procedures for handling or working with a particular substance. They include such data as physical data, toxicity, health effects, first aid, reactivity, storage, disposal, protective equipment, and spill/leak procedures. Who are MSDS’s for? Employees who may be occupationally exposed to a hazard at work. Employers who need to know the proper methods for storage, ect. Emergency responders such as firefighters, hazardous material crews, emergency medical technicians and emergency room personnel. What agencies require MSDS? OSHA - is responsible for ensuring that the hazards of all chemicals produced or imported are evaluated, and that information concerning their hazards is transmitted to employers and employees EPA – Environmental Protection Agency State and Local Agencies – Requirements vary by State Other Countries – Regulations similar to OSHA’s are found in virtually every country

What are the Penalties for Non-Compliance? Every employee must have “ready access” to all MSDS sheets. OSHA fines can be up to $70,000 or more depending severity of violations. MSDS compliance is the most frequently cited violation Maximum fine for a serious violation capable of causing death is $12,000 Maximum penalty for a “willful” or knowing violation is $250,000 New Severe Violator Enforcement Program targets firms who have repeat violations What items do not require MSDS’s?
