Safe, Supportive and Disciplined School Environment – Procedural Policy Rescinded policies: SM – 06 Management of Behaviour in a Supportive School Environment – Schools and Discipline SM – 16 School Disciplinary Absences SM – 05 Physical Restraint and Time Out Procedures Students with Disabilities

Safe, Supportive and Disciplined School Environment – Procedural Policy procedure aligns with expectations under The Code of School Behaviour (substantive policy) legislative obligations to maintain good order and management of the school requirement for all State schools to have an approved Responsible Behaviour Plan for Students provision for the use of detention, suspension, exclusion, cancellation of enrolment and a Behaviour Improvement Condition guidelines on Time Out & Physical Restraint will apply to all students (not just SWD)

Safe, Supportive and Disciplined School Environment – Procedural Policy Grounds for suspension are: disobedience misconduct other conduct of the student that is prejudicial to the good order and management of the school or State schools

Safe, Supportive and Disciplined School Environment – Procedural Policy Misconduct includes misconduct occurring while the student is: attending or representing the school; or travelling to or from the school

Safe, Supportive and Disciplined School Environment – Procedural Policy Grounds for suspension with a recommendation for exclusion the student’s disobedience, misconduct or any other conduct must be so serious that suspension of the student is inadequate to deal with the behaviour contravention of a Behaviour Improvement Condition

Cancellation of enrolment Responsibilities of Principal: Principal can cancel the enrolment of a post compulsory age student if the student displays persistent refusal to participate in the program of instruction issue Advice of Non-compliance Letter discuss strategies to address non-compliance with student and parent/carer issue Show Cause Notice

Cancellation of enrolment Responsibilities of Principal: document advice from Guidance Officer issue Non-cancellation Notice or Cancellation Notice Principal must give the person under the cancellation a notice stating that an application for enrolment at the school may not be made for the stated period, of no more than 12 months, from the date of the notice.

Safe, Supportive and Disciplined School Environment – Procedural Policy Right of Appeal Students are able to make a submission to appeal against: 6 – 20 day suspension recommendation to exclude cancellation of enrolment or to request a review of a Behaviour Improvement Condition

Safe, Supportive and Disciplined School Environment – Procedural Policy Behaviour Improvement Condition Before applying suspension with recommendation to exclude, Principal may consider using BIC according to the following procedures: Give notice to student stating appropriate BIC, including: - reason for BIC - period of BIC (not more than 3 months)

Safe, Supportive and Disciplined School Environment – Procedural Policy Behaviour Improvement Condition Procedures Give notice to student stating: -details of program -student’s right to request review of BIC within 5 school days after notice is given to student -details about how to make a submission to EDS requesting review of BIC
