Steps We Have Taken Sent inquiry letter to all 50 states on behalf of UMass campuses – Mid-March Collected, organized, and prioritized responses – 45 responses as of now – Created a database in Confluence 3

Steps We Have Taken (Cont.) Shared information that has been collected with campus colleagues – Bi-weekly updates – Debriefing via at the end of March Engaged in information sharing in the higher education community – Speaker series – UMassOnline Blog – President’s Forum 4

What We Have Learned State policy status – Some states are still developing their policies Criteria in determining whether an out-of-state institution is required to register – Physical presence Facility Personnel (faculty/staff) Marketing Recruitment Internship/practicum/clinical experience/student teaching – Accreditation Regional accreditation by agencies recognized by the U.S. Education Department – Being a public institution In some states, public institutions are exempt. 5

States that Require Authorization – Basis of evaluation Several states require authorization at the course/program level Need to confirm whether UMass can register as a system – Application process Some tend to be complicated and lengthy – Application cost Fee structure varies across states, e.g.: – Initial program-based registration – Annual renewal fees – Site visit – Additional fee for each program added in the future 6

What We Have Learned (Cont.) States that Require Initial Actions – Send required documents and information, e.g.: Accreditation information State licenses Basic information about the campuses (name, address, contacts, etc.) Questionnaire 7

Next Steps 1.Collect relevant data from each campus and UMassOnline about activities in other states. 2.Determine with the campuses the states on which to focus in seeking compliance. 3.Follow up with the states that require initial actions. 4.Obtain and share with the campuses updates from states that are still formulating their policies. 5.Start taking actions that are required by states that do not require authorization. 8

Questions for the Campuses – Physical Presence Does your campus possess, rent, or maintain any building, room, or equipment in another state? Does your campus employ anyone (faculty or staff) with a direct relationship to the offering of online programming who resides in states other than your own? – e.g. Does your campus provide payment reportable for income tax purposes via either a W-2 or Form 1098 to any individual resident of the state for any purpose associated with students in another state? Does your campus conduct practica, clinical or field experience or arrange for internships, student teaching in states other than your own? 9

Questions for the Campuses – Physical Presence (Cont.) Does your campus maintain a telephone number with a local area code or a postal address (including P.O. Box) with a local zip code in another state? Does your campus provide core academic support services, including but not limited to admissions, evaluation, assessment, registration, financial aid, academic scheduling, mentoring, examination administration and faculty hiring and support in another state? 10

Questions for the Campuses -- Marketing Does your campus specifically direct marketing materials to residents in another state, rather than marketing on the web to a larger and less defined target population? – Including, but not limited to: newspaper advertising, direct mail campaigns, billboards, kiosks, TV ads in local stations? 11

Questions for the Campuses -- Recruitment Does your campus employ or contract any recruiters or recruitment agencies located in another state? Does your campus recruit students in another state via any means of media which originates in that state? 12
