USMC Build Up Issue – NDAA Section 2207 restrictions on use of funds affects DOD’s ability to proceed with the Guam military realignment. Conditions – Prior to the expenditure of GOJ or MILCON funds: –CMC provides Congress with preferred force laydown in the Pacific; –SECDEF submits a master plan supporting the above; –SECDEF certifies that tangible progress has been made with the FRF; –Coordinated federal agency plan for addressing non-military infrastructure and utilities requirements on Guam –Independent assessment of the U.S. force posture in the Pacific region Exceptions – SECDEF may use funds to carry out: –Complete NEPA analysis for a LFTRC SEIS –Ongoing analysis on the impacts to coral reefs in Apra Harbor
