Question of the Day Have you ever bought something with a warranty? What has been your experience? Was it good or bad?

Warranties A warranty is a promise made by a seller about the quality or performance of goods for sale. Many warranties also include a statement of what the seller will do to remedy the situation in the event of a problem with the product. All warranties are not the same, so it is important to compare warranties while shopping.

Express Warranties Express warranties and implied warranties are two types of guarantees. An express warranty is a statement-written, oral, or by demonstration-concerning the quality or performance of goods offered for sale

Implied Warranties An implied warranty is an unwritten promise, created by law, that a product will do what it is supposed to do.

Disclaimers Consumers should also be aware of disclaimers-clauses or statements in a warranty that attempt to limit the seller's responsibilities should any problems arise with the product.

Basic Consumer Questions Warranties give consumers important rights, and therefore are probably the most basic form of consumer protection. Warranties answer several essential consumer questions: What parts and repair problems are covered? Are any expenses excluded from coverage? How long does the warranty last? What will you have to do to get repairs? What will the company do if the product fails? Does the warranty cover "consequential damages," that is, other losses caused by the product's failure? For example, if your freezer breaks and all your food spoils, the loss of the food would be consequential damages. Are there any conditions or limitations on the warranty?

Consumer Protection Most people think they have no remedy for a defective product unless an express warranty has been provided. However, the implied warranty of merchantability provides a legal remedy and may actually extend beyond the duration of any express warranty.

Consumer Protection The implied warranty of merchantability, as codified in the Uniform Commercial Code and adopted in some form by the legislatures in all 50 states, terminates the common-law idea of caveat emptor, or "let the buyer beware." In fact, in response to the growth of government regulation, some critics of consumer protection describe the contemporary marketplace with the somewhat tongue-in-cheek paraphrase "let the seller beware."

Warranty Law Warranty law does not guarantee perfect products. However, consumers who avoid impulse buying, comparison shop, and carefully inspect products before purchasing them are more likely to be satisfied with their purchases. A disclaimer attempting to exclude a seller's liability for physical harm caused by consumer goods is considered unconscionable.

Warranties If the seller does not live up to the promises made in the warranty, the contract has been breached.

Express Warranties An express warranty is a statement—written, oral, or by demonstration—concerning the quality of goods offered for sale that become a part of the bargain between the parties.

Express Warranties Not everything a seller says is a warranty. Puffing—is a seller’s statement of an opinion or an exaggeration.

Defective product may be brought or mailed, freight pre-paid, to purchase place, authorized service center, or Service Department, excellent Digital Cameras, Inc., 3rd & Maple Streets, Arlington, PA 15616, for free repair or replacement at our opinion. Warranty does not include cost of inconvenience, damage due to product failure, transportation damage, misuse, abuse, accident, or commercial use. For information, write Consumer Claims Manager at previously listed Arlington address. Send owner’s name, address, name of store and service center involved, model, serial number, purchase date, and description of problem. This warranty gives specific legal rights. You may have other rights that vary from state to state. This warranty becomes effective upon purchase. Mailing the enclosed registration card is one way of providing purchase date but is not required for warranty coverage.

Does the buyer have to do anything to make the warranty effective? 3. What is covered—the entire product or only certain parts? What is promised—repair, replacement, labor, postage? Is this a full or a limited warranty? Why?

Implied Warranties An implied warranty is an unwritten promise, created by law, that a product will do what it is supposed to do. Implied warranties apply only to products sold by bona fide, or authentic, dealers of that product.

Always, carefully inspect any goods you buy for defects. Be especially careful with used cars. It is wise to have a mechanic you trust examine the car before you purchase it. Be sure to carefully read all instructions that come with a product. If you fail to use the product properly, or if you use it for an improper purpose, you may invalidate the warranty.

The cost of fixing the car is greater than the sale price. -Deidre buys a dress after telling the sales clerk that she plans to wash it in a washing machine. The clerk replies, “That’s fine. This material is washable.” Deidre washes the dress in her washing machine and the dress shrinks.

-A salesperson tells Neva, “This is the finest digital camera on the market. It will last for eight years.” Eight months later, the button that advances the photos stops working. -Scott steals a diamond ring from a jewelry store and sells it to Maria after telling her his mother gave it to him. -Trina orders a book from a bookstore’s Web site. The Web site says “Hardcover Edition, $12.95,” and includes a picture of the book’s cover. Five days later, Trina receives the paperback edition of the book in the mail.

Disclaimers A disclaimer is an attempt to limit the seller’s responsibilities should anything go wrong with a product.

The Case of the Guitar That Quit Shari wants to buy a new guitar. She shops around to compare prices at a few different music stores. City Music offers the best price at $300. so Shari buys the guitar there. On the sales receipt is a clause that reads: “This constitutes the exclusive statement of the terms of agreement between the parties. Seller makes no warranties either express or implied with respect to this product.” The third time Shari plays the guitar the neck breaks.
