Offences against the person
The offences we will be covering are: Assault Battery Actual Bodily Harm (ABH) Grievous Bodily Harm and Wounding (s20) Grievous Bodily Harm and Wounding with intent (s18)
Assault An act or words which cause the victim to anticipate that there will be some violence towards him. E.g. A raised fist
Battery Application of force without the consent of the other. E.g. pulling on a woman’s skirt
Actual Bodily Harm Any assault which causes discomfort, hurt or injury to another. E.g. Small grazes and bruises
S20 Serious harm Split into grievous bodily harm and wounding E.g. GBH broken ribs Wounding- stab wound.
s18 Same as s20 only with the intention to wound or cause serious harm Or an offence which involves violence towards police officers
We will also be learning some defences Insanity Automatism Intoxication Consent Self defence
Insanity Where someone has a “disease of the mind” which means that they are not responsible for their actions
Automatism Where an external factor causes a person to not be in control of their actions
Intoxication Not technically a defence Where a person is under the influence of drink or drugs
Consent Where a person has allowed for the act to be committed Can only consent to certain acts
Self defence Where a person is only acting to protect themselves or their property or to prevent a crime
