THB Data collection in Latvia

Criminal Procedure Information System The Information Centre of the Ministry of the Interior is the manager and holder of the register. Information regarding the criminal proceedings initiated beginning with 1 January 2011 are compiled in the System. Amount of information to be included in the Criminal Procedure Information System: - all the procedural decisions taken in criminal proceedings, except for the decisions taken in relation to special procedural protection and special investigative actions;

THB Data collection in Latvia - regarding the person directing the proceedings; - regarding the persons who have the right to assistance of a defence counsel; - regarding the persons who have been held criminally liable; - regarding the legal persons in the interests of which a natural person committed the criminal offence; - regarding the natural person who suffered from the criminal offences and the person whose death occurred as a result of the criminal offence;

THB Data collection in Latvia - regarding the detected criminal offences; - regarding the legal person which suffered from the criminal offences; - date on which the person was recognised as a victim; - nature and amount of the harm caused; - regarding the representative of the victim; - date on which the person was recognised as the representative of the victim; - material evidence seized and property attached during the course of the criminal proceedings.

THB Data collection in Latvia Court Information System The Ministry of Justice is the manager of this System. The Court Administration is the holder of this System. This System is in use since The System contains information regarding civil cases, administrative cases, administrative violation cases, criminal cases, materials which are considered in the order of criminal proceedings.

THB Data collection in Latvia The System contains publicly accessible statistical data on: - convicted persons (according the Criminal Law Sections); - exonerated persons (according the Criminal Law Sections); - number of convicted persons and sentences (according the Criminal Law Sections; combinations of sentences); - suspended sentences within criminal cases (according the Criminal Law Sections); - persons against whom criminal cases are terminated (according the Criminal Law Sections);

THB Data collection in Latvia - persons which criminal cases are retried (according the Criminal Law Sections); - persons which cases are sent for the performing of procedural actions (according the Criminal Law Sections); - number of convicted persons who have committed an offence in organized groups (according the Criminal Law Sections).

THB Data collection in Latvia THB data is also collected from: - NGOs providing social rehabilitation services for human trafficking victims: data on identified, presumed and assisted victims, officially recognized victims who can receive state funded social rehabilitation services; - Ministry of Foreign Affairs: data on identified victims by consular officials, assisted victims referred by foreign law enforcement agencies or NGOs; - Municipalities: data on identified victims by social workers; - Other stakeholders.

THB Data collection in Latvia Ministry of the Interior provides: - Implementation of the responsibilities of the National Coordinator in human trafficking combating issues which is considered as an alternative mechanism of National Rapporteur. National Coordinator is a coordinating body for the implementation of anti—trafficking policies. - Organising the work of the National Task Force.

Hard Data compares the data collection mechanisms in the CBSS Member States and provides an overview of the categories of information on human trafficking cases that is currently collected, by whom it is collected, analysed and published as well as its public availability. The study underlines the need to develop comparable data collection mechanisms and serves as a tool for organisations to use to enhance their own systems. Minor Persons Support Information System With financial support from the Prevention of and Fight Against Crime Programme of the European Union European Commission – Directorate- General Home Affairs Minor Persons Support Information System

The main goal of the project «Development of the Minor Persons Support Information System»: to facilitate the protection of the children’s rights because each child has rights to develop, not to be involved in crime and not to suffer from criminal activities. Project duration December 2009 – April 2012

Minor Persons Support Information System Legal basis for the System is 22 May 2012 Cabinet Regulation No 348 «Minor Persons Support Information System Regulations». These Regulations were developed according Protection of the Rights of the Child Law the Section 64. Competence of the Ministry of the Interior «4) ensure the operation of an information system for the support of minors. The Cabinet shall determine the procedure for the creation and use of an information system for the support of minors, as well as the amount of information to be included in such a system and the procedure for processing information.»

Minor Persons Support Information System The System is an information technology solution that ensures an effective information processing on minors who are in crisis situations, thus facilitating efficient exchange of information and cooperation among the relevant law enforcement, social, educational and other institutions, as well as prevention of early juvenile crime and victimization. The system will enable opportunities to detect weaknesses in the child protection field, then work with the child and / or family will start earlier using the resources of the involved institutions in the most effective way.

Minor Persons Support Information System Users of the System: - Orphan courts; - Social Services; - Law enforcement agencies (State Police, State Border Guard, Municipal Police); - Doctors; - State Probation Service; - Prison Administration; - State Inspectorate for Protection of Children’s Rights; - Ombudsman; - Branch ministries (e.g., Ministry of Welfare, Ministry of Education and Sciences, etc.) - Other relevant institutions; - Researchers, students, inhabitants (can use statistical reviews).

Minor Persons Support Information System Cases to start information processing: - The child's life, health or development is at risk of violence, or there are reasonable suspicions of child abuse, as well as lack of care or due to home circumstances (social surroundings; - The child has been abandoned or is in conditions which are dangerous for a child and can affect child’s life, health or development; - A child is begging, child is vagrant or takes other actions that could lead to illegal activities; - The child has deliberately left the family, guardian, foster familyy, guest family, child care facility, social correction educational institution; - The child threatens his/her health and development, including using alcohol, toxic, narcotic, psychotropic or other intoxicating substances; - Child has committed the acts for which an administrative or criminal liability is provided.

Minor Persons Support Information System Positive benefits: - Introduction of centralized (national) accounting in regard to the minors who need help; - Digitization and uniformity of «paper inventories» (eg, custody records, minors’ preventive records); - Existing data integration (multi-institutional information system linking) and missing data collection; - Online access to data of the relevant national/local authorities in the field of child protection throughout the territory of Latvia; - Introduction of the information exchange platform and system of signals of involved services; - Introduction of the information evaluation system of unchecked information; - Provision of support: for immediate provision of individual assistance; for assessment of the situation; for short, medium and long-term planning; for search of missing children; for statistical processing of the data, the producing of public reviews, scientific researches.
