The Challenge
In contracting with DoD Agencies and subcontracting with DoD Primes small businesses (SBs) and Non-Profit Agencies (NPAs) are required, like any other contractor, to comply with the requirements of the Federal Acquisition Regulations (FAR), Defense FAR Supplements (DFAR), Public Law and Executive Orders. As an example, MVLE has received a subcontract that requires certifying to: Export Control (ITAR/EAR) Affirmative Action (FAR ) Equal Opportunity (FAR ) and EEO Pre-Award Compliance (FAR ) Certificate Regarding Responsibility Matters (Far ) Certification of Toxic Chemical Release Reporting (FAR ) Certification And Disclosure Regarding Payments To Influence Certain Federal Transactions (Far ) The challenge to Small Business (SB) and NPA’s
On many of its subcontracts MVLE is required to Certify Cost and Pricing data, Truth in Negotiating (TINA) (USC § 2306a), Procurement Integrity(41 U.S.C. §423, implemented at FAR 3.104), and Contractor Code of Business Ethics and Conduct (FAR ) SB/NPA’s operate with low overheads. We tend to be “one deep” at every position.
