Three R’s of Consultations Request for a consultation Recommendation documented Report back to the requesting physician

July 2005TUMG/Compliance Was a consultation requested? The request for a consultation may be made in written or verbal form, but the request for the consultation must be documented in the patient’s medical record.

If the consultation was requested, did the consulting physician: perform the consultation and, document his or her recommendation in the patient’s medical record and, communicate findings/recommendations by written report to the requesting physician or other appropriate source?

July 2005TUMG/Compliance When all three consult requirements are met (Request, Recommendation, and Report) AND all three E/M Key Components (HX-EX-MDM) are documented AND support the level of consult selected, then the physician may bill a consult code. The level of the E/M consult service should be selected based upon the three (3) key components performed and documented: *History *Examination *Medical Decision Making

Documentation Caution If any of the three consult requirements are not met (request, recommendation, or report) then a consult code may not be billed. If consult requirements are met, but the three E/M key components are not documented, then a consult may not be billed.

 Consultations may be billed based on time if the counseling/coordination of care constitutes more than 50 percent of the face-to-face encounter between the physician and the patient and/or family.  The requirements of Request, Recommendation and Report must also be met.

Is an encounter a consultation if a patient’s “complete care” is transferred to the consulting doctor? Dr. ADr. B Dr. A I would like you to assume all care of my patient That’s fine. Just have your office send over all records.

July 2005TUMG/Compliance Medicare Carriers Manual states: “ Pay for an initial consultation if all the criteria for a consultation are satisfied. Payment may be made regardless of treatment initiation unless a transfer of care occurs.” “A transfer of care occurs when the referring physician transfers the responsibility for the patient’s complete care to the receiving physician at the time of referral, and the receiving physician documents approval of care in advance.”

July 2005TUMG/Compliance Medicare Carriers Manual states If a “complete transfer of care” occurs, “The receiving physician would report a new or established patient visit depending on the situation and setting (office or inpatient).”

Which scenario describes a consult? Which describes a transfer of care? Dr. Gim, an Internal Medicine physician, recommends that a patient see a neurologist for sudden onset of numbness and coordination problems. Dr. Gim, an Internal Medicine physician contacts a patient’s OB/GYN physician who agrees to serve as PCP for the patient. Dr. Gim, an Internal Medicine physician refers the patient to a surgeon because diagnostic tests revealed significant gallstones. Consult: total care not transferred New or established patient: total care of patient transferred in advance Consult: total care not transferred

Does initiation of a diagnostic and/or therapeutic service preclude the billing of a consultation service? NO. A diagnostic and/or therapeutic service can be initiated during the course of a consultation. The guideline applies to all payors EXCEPT LA Medicaid. NOTE: LA Medicaid Consult Guidelines state “the physician consultant may initiate diagnostic tests;” however, if therapeutic services are initiated, a consult cannot be billed.

Same-Specialty Consultations To report a consultation service, do the requesting physician and the providing physician have to be from different specialty fields (e.g., internal medicine and surgery)?  CPT does not limit the use of the consultation codes according to whether or not the physician providing the consult service is of a different specialty field than the physician requesting the advice or opinion.

Same Specialty Consultations “ Pay for a consultation if one physician in a group practice requests a consultation from another physician in the same group practice as long as all of the requirements for use of the CPT consultation codes are met.” Medicare Carriers Manual 15506

Can Non-Physicians Request Consults?  Non-physician practitioners, e.g., nurse practitioners, certified nurse- midwives, or physician assistants may request a consultation.

Diagnosis Known or Unknown Is it appropriate to code a consultation when the diagnosis is already known by the requesting physician and/or by the consulting physician?  CPT coding guidelines do not require that the diagnosis be known or unknown at the time of the request for consultation.  A consultation may be reported regardless of whether the diagnosis is known or unknown, provided the requirements for a consultation are met.

LA Medicaid – Consult Guidelines  If by the end of the service, the consulting physician determines and documents in the patient’s record that the patient does not warrant further treatment by the consultant, the consultation code should be billed LA Medicaid Professional Services Training Manual page 23  If, by the end of the consultation, the consulting physician knows or suspects that the patient will have to return for treatment, the appropriate level evaluation and management (E/M) code should be billed rather than the consultation code.

LA Medicaid Consults cannot be billed if the service falls in the Global Surgery Period: For procedures defined as having global surgery periods there is no opportunity to bill an Evaluation and Management service (visit) the day before or the day of the procedure. NOTE: This rule pertains to any physician in the specialty performing the procedure (e.g., Pulmonary, Cardiology, etc.). If a consulting physician is to perform ANY surgery, a consult code may not be billed.

LA Medicaid LA Medicaid will not pay for a procedure and a visit on the same day. LA Medicaid will not pay for follow-up consults. LA Medicaid will not pay for confirmatory consults.

Are these consults? None of the scenarios are LA MEDICAID – use Medicare/Commercial Consult Guidelines in determining whether the situation warrants a consult code.

Consultation Scenario #1 The primary care physician evaluates an established patient who presents to the ambulatory care facility with a complaint of rectal bleeding. The PCP requests a GI consultation. The consulting GI physician documents a history, exam, and medical decision making, and performs a diagnostic colonoscopy.

The GI physician can bill a consult as long as a report is sent to the requesting physician AND meets all the E/M documentation (HX-EX- MDM) requirements for a consult code. As the consultation was performed by the same physician on the same day as the diagnostic colonoscopy, modifier -25 should be appended to the consultation E/M code. Code should be reported for the diagnostic colonoscopy.

Consultation Scenario #2 A 10-year-old patient presents to the ambulatory pediatrics department with a painful, swollen, right wrist. The pediatrician decides to request an orthopaedic consultation. The orthopaedic physician evaluates the patient in the orthopaedic clinic and then confers with the pediatrician. The pediatrician then transfers definitive care to the orthopaedic physician who applies a splint.

Report requirement not met by conferring with the pediatrician. A written report is required. Transfer of care for the ortho problem from the pediatrician to the orthopedist DOES NOT preclude billing of consult. To qualify as a Transfer of Care, the pediatrician would have had to request in advance and received agreement that the orthopaedist assume total care of the patient. In this instance, the care for ONLY the orthopaedic problem was transferred. If the orthopaedist writes a report AND documents all three E/M Key Components (History, Exam and Medical Decision Making), a consult code may be billed, along with the application of the splint.

Scenario : Is this a consult? A 52-year-old male makes an appointment with the urologist after experiencing flank pain and hematuria. The urologist documents a history, exam, and medical decision making and recommends further treatment.

No. This is either a new or established patient visit, depending on whether the urologist had seen the patient within the last three years (Medicare or Commercial payors). This is a self-referral; not a consult.

Documentation Tips If the request for a consult comes from a TUMG or TUHC physician, be sure to cc that physician in your dictated note. Be sure your dictation contains the name of the requesting physician. The dictated note could begin with a statement such as: I saw this patient at the request of Dr. GIM for an evaluation of _________________ If the requesting physician is an outside physician, a copy of the report must be in the medical record. Otherwise, a consult code may not be billed.
