BAKER COUNTY ZONING ORDINANCE REVISION 2008

Why Revise the Ordinance? 3This is the first complete revision since Baker County’s Zoning Ordinance is out of date with state law. 3Planning needs and challenges have changed over 24 years. 3Revising will allow us to better serve you.

What does the Ordinance do? 3Applies to land outside of incorporated cities that isn’t federally owned. 3Implements Comprehensive Land Use Plan. 3Defines what is allowed in each zone, gives regulations for dividing land, special considerations, decision-making procedures.

What doesn’t the Ordinance do? 3Define zone boundaries. Those are set by maps from the Comprehensive Plan. 3 Allow Baker County to set aside state regulations. 3Change application processing fees 3So… this process can’t change any zones or change state regulations and rules.

Revising the Ordinance will... 3Change the regulations in many zones 3Change procedures for processing applications 3Create new guidelines for certain projects 3Most importantly, give a balanced reflection of what is important to Baker County

What’s New? 3New Decision Making Procedures l All decisions are Type I - Type IV 3Temporary Permits l Could allow a seasonal use, like a fruit stand 3Sensitive Bird Habitat Overlay l Consultation between developer and ODFW

What’s New? 3Wireless Communication Facilities 3Commercial Wind Power Generation Facilities

What’s Changed? 3Transportation Standards l Amended to be consistent with plan, includes a new proposal 3Exclusive Farm Use/ Timber-Grazing l Modified to be consistent with state laws and rules 3Mineral Extraction l Dwelling

What’s Changed? 3Motor Sports Limited Use Combining Zone l Clarified what uses are permitted, what uses require Planning Commission approval 3Home Occupations l Expands what is allowed, breaks up by type
