Brussels, New Approach2July 2007 IInformation and CCommunication SSystem for MMarket SSurveillance I C S M S

Brussels, New Approach3July 2007 Effective Market Surveillance Needs...  quick and in-time INFORMATION on defective products and measures taken by other market inspection bodies  a DATA BASE covering all and any products distributed throughout Europe including up-to-date information on product INVESTIGATION/TESTING  EVALUATION TOOLS to compare existing testing/examination methods and to ensure a uniform level of quality  efficient co-operation with CUSTOMS authorities  an attractive means to inform Employers, workers and the public about unsafe products

Brussels, New Approach4July /95/EC – General Product Safety Directive 89/336/EEC – Electromagnetic compatibility (EMC) 1999/5/EC R&TTE – Radio equipment and telecommunications terminal equipment 90/396/EEC – Appliances Burning Gaseous Fuels 94/9/EC – Potentially explosive atmospheres (ATEX) 2001/14/EC – Noise Emission (Outdoor Directive) 98/37/EC – Machinery Directive 73/23/EEC – Low Voltage Directive 88/378/EEC – Toy Safety Directive 97/23/EC – Pressure Equipment Directive 89/686/EEC – Personal Protective Equipment Directive 95/16/EC – Lift Directive 87/404/EEC – Simple Pressure Vessels Directive 94/25/EC – Recreational Craft Directive 89/106/EEC – Construction products 75/324/EEC Aerosol dispensers DIRECTIVES covered in 2007 more to add incl 67/548/EEC, 98/8/EC, 76/769/EEC, 1999/45/EC, 2000/9/EC

Brussels, New Approach9July 2007 The ICSMS Database Originally a monolithic structure, ie all parts imbedded – worked well, but changes and additions were made more costly and lengthy due to knock-on effects on other parts Product information Public area Newsletter subscription Networking Evaluation Search function Mailing Archive Data import – a year ago we decided to change the structure:

Brussels, New Approach10July 2007 The ICSMS Database – new modular structure Well-defined Applications-Programmers-Interface (API) makes changes possible without influence to the rest of the software („BUS-System“) Connection to other IT-Systems, eg RAPEX, is more simple Mailing Public area Newsletter subscription Net- working Product information Search function Evaluation Data import semi automatic Archive Info server GRAS interface (development)

Brussels, New Approach11July 2007 Example of a search result for a “saw“ under 98/37/EC

Brussels, New Approach12July 2007 Example of one part of the stored information Photograph aids identification Bar codes and TARIQ numbers are available to help authorities identify goods at retail outlets and at borders

Brussels, New Approach13July 2007 A PRODUCT INFORMATION DATA SET includes data on:  General information about the notifying authority  Product identification criteria  Distribution  Relevant Provisions and Standards  Conformity  Depth and scope of testing  Test results and a classification of defects  Accidents occurred  Measures taken by surveillance authority

Brussels, New Approach14July 2007 FUTURE DEVELOPMENTS  Evaluation tools will allow users to fine-tune procedures and to produce analysis of project results and produce charts etc of outputs.  Appropriate platform for complaints: in accordance with the newly revised General Product Safety Directive, ICSMS will create an attractive platform for citizens to address complaints  Templates of forms will be electronically accessible and with facility to be filled in and submitted on-line  Link to RAPEX – will eliminate need for double entry of data  To link ICSMS to EMARS so together they can give comprehensive information across the range from basic skills, project planning through to defective product information and statistical outputs

Brussels, New Approach15July 2007 Entry RAPEX Local MS Authority National Focal Point (NFP) Validation Case No Translation Local MS Authority Local MS Authority ICSMS Interface RAPEX & ICSMS – likely link structure once GRAS system is operational Validation DG SANCO

Plans now are being developed to set up ICSMS as an AISBL * based in Belgium. However, the ICSMS members are flexible on its structure if changes are needed for ICSMS to be developed into an EU wide system for the New Approach Developments in structure and organisation of ICSMS * AISBL = Association International Sans But Lucratif

Brussels, New Approach24July 2007 QUESTIONS? To Sum Up, ICSMS:  Is fully operational in 11 member states plus Switzerland  Is more than a secure product database, it provides the tools for cooperation between market surveillance authorities, including Customs, but also is a public platform for information and recalls  Will link to RAPEX and generate Safeguard and other forms with the aim to have “single key entry” of data  With EMARS it will provide the means to share and improve expertise on market surveillance through best practice techniques, guidelines, handbooks, procedures and training  With EMARS it can meet the information needs of the new approach, from: developing skills and plans; through cooperation between authorities; to making accessible and analysing information on products  It is being put on a firm legal basis in Brussels, and the members are flexible in how it develops to ensure it meets the EU Commission's and all MS’ requirements
