What is a swing vote?

A determining vote, the one vote that does not clearly belong to one of the either conservative or liberal blocs on the Court

What is Judicial Review?

The power of the Supreme Court to rule federal, state or executive orders unconstitutional, established by Marbury v. Madison

Gideon v. Wainwright did what?

Established that the state must provide a lawyer for defendants who can not afford a lawyer.

What does stare decisis mean?

Latin for, let the decision stand, which establishes a precedent which is to be followed by other courts

In what area does the Supreme Court never get involved?

Foreign policy issues.

Brown v. Board of Education did what?

Ended the segregated society prevalent in the South, schools were to be desegregated with all deliberate speed. Overturned the Plessy v. Ferguson case.

Bush v. Gore did what?

Ended the manual recounts in Florida during the 2000 Presidential election, giving George W. Bush the presidency.

How often does the Supreme Court overturn state and federal statutes?

A lot!! Over a 1000 state laws and about 150 federal laws. This is their job, after all.

What did Miranda v. Arizona do?

Required police to inform a suspect of their rights at the time of arrest. Any confession after arrest and the rights are not read, the confession cannot be used in court.

What did the Casey Martin case prove?

It did not overturn the Americans with Disabilities Act, it did help clarify what was the intent of the law.

What kind of cases does the Supreme Court hear?

Actual cases that involve real people and real issues, and must include a constitutional issue.

Which case invalidate the Missouri Compromise?

The Dred Scott case, which established that a black man was property and could not sue in federal court.

How does the Supreme Court shape public policy?

Through legal institutions and political institutions

What is precedent?

When the Supreme Court rules on a case, that ruling becomes the guideline for other courts to follow in similar cases. A judge that does not follow that precedent rules on a case that will likely be overturned.
