The existing regulations were formulated based on the types of chemicals such as industrial chemicals, pesticide, phamaceuticals and schedule wastes. They have their own system of classification and hazard communication (label and SDS). This table shows what are types of chemicals governed by a different relevant agencies/ ministry and what are systems already inplaced.

A CURRENT STATUS No mandate to be as a National agency to coordinate steps towards GHS implementation; Implementation status varies by authorities; Activities conducted with cooperation among interested parties and affected parties ; DOSH Awareness, training & education on HAZCOM have been taking step ; Existing legislations is being reviewed & enact new laws with the GHS as basis Development of an GHS manual based on GHS; New law to be gazetted by 2008 & enforcement by 2010

CHALLENGES ENCOUNTERED Labelling according to CPL Reg. with additional wording complying with Poisons Act To harmonize hazard communication within Malaysia Employers’ own staff well versed in both languages can do translation. NIOSH Malaysia to take up role of translating CSDS Overlapping jurisdiction on some chemicals E.g. 31 industrial & laboratory chemicals which is under Poisons Act & USECHH Reg. Translation of label and CSDS into Bahasa Malaysia Lack of translators well verse in chemical safety

CHALLENGES ENCOUNTERED Labelling of small size containers Minimum label size bigger than container surface area Classification of chemicals inadequate information Tagging is allowed by CPL Reg. If tagging not possible, will consider appeal on case-by-case basis Users advised to source out from suppliers who can provide the information

CHALLENGES ENCOUNTERED Validity of CSDS information, especially for mixtures Inconsistencies Suspect ‘cut & paste’ Testing data/facilities For locally manufactured products Need to establish a national chemical registry National standards organization, SIRIM, provide services to formulate CSDS & carry out physical-chemical tests

CHALLENGES ENCOUNTERED Nationwide seminars & dialogue sessions Media coverage Newsletters of trade associations, e.g. CICM Nationwide enforcement audits Feedback from users Market forces- users buying from suppliers complying with CPL Reg. Awareness Suppliers’ ignorance of law Attitudes of suppliers Additional costs, difficult to get translators Compliance by suppliers Many suppliers do not belong to any trade associations

CHALLENGES ENCOUNTERED Industrial & domestic products Labelling of products than are used both for domestic (house) and for work. E.g. gas cylinders, bleaches, detergents, etc. To label according to CPL Regulations unless product solely meant for house use

CONCLUSIONS There is a need to establish a National Coordinating Committee to coordinate steps towards GHS adoption in Malaysia; perhaps by implementing the lingkages,clustering and synergy elements.
