The module "The Fundamentals of legislation on State Public Health Supervision" Nicolae Opopol, Ph. Dr., Professor

Introduction Public Health Faculty trains specialists who will work in public health centers, the latter being state structures. This feature dictates the specific knowledge vhich every public health specialist needs to acquire. All public health structures are operating in a well- defined legal area. In accordance with the Republic of Moldova Constitution, all activities of state structures should benefit from a better legal support completed. This requirement refers to all activities of the State Public Health Supervision.

The specific activities of the State Department of Public Health Surveillance The State Public Health Supervision Service is involved in legal relations with: -different operators (producers, transporters, vendors, etc.). -investigating bodies; -state inspections (State Labour Inspectorate, the State Environmental Inspectorate, the National Agency for Food Safety, etc..) -different authorities, central and local government; -nongovernmental organizations and populatin, etc..

Demanding Therefore, specialists which activate in this service must possess a minimum level of legal knowledge to exercise their functions in order to communicate effectively with the public and private institutions and population, and to provide scientific and legal grounded interrelationships in public health issues.

The purpose of the module The main purpose of the module is to contribute to the accumulation by the masters of the knowledge in legal support of public health activities (imperative and permissive). The main training objectives of the module consists in knowing and applying the knowledge of legal provisions in public health supervision activities. In the classes are the following lectures: Public health as integrated system of health protection measures and assuring of community health. The importance of providing legal support in community health. The concept of law, rules of law. The actions of law rules in time, in space and on people. Civil legal relationships. Individuals, subject of civil legal relationships. Sources of medical law. Legislative and normative acts in the field of healthcare.

In the classes are the following lectures: Administrative law. Separation of powers. Legal liability. General principles of liability in public health. Concept and principles of medical law. Administrative acts. Legal liability. The concept of legal liability. Contravention. Liability offenses. Criminal, offense. Civil contracts to provide services. Rental, lease, partnership. Public-private relationships.

The seminars and practical works will examine: The essence of medical law sources: organic and ordinary laws, ordinances, government decisions, laws departmental internanţionale acts (treaties, agreements, conventions, etc.). Concept and principles of medical law. Grounds liability - u nlawful nature of the act wrongful conduct, the unlawful nature of the offense, the antisocial character, damage. Forms of legal liability for non-compliance to sanitary and anti- epidemic norms. The importance of public services. State Public Health Supervision Service.

The seminars and practical works will examine: Health care system in Moldova. Principles of state health system. Legal structure. Legislative and normative acts in the field of healthcare. Legal liability. The concept of legal liability. Contravention. Liability offenses. The action of offenses act in time, in space, on the person. The sanctions. Finding the contravention. Labor relations in health care, areement conclusion, modification, suspension, termination of employment. Working time, wages, the right to rest, work discipline.

Practical skills Upon completion of the module the masters will know the rules of law (mandatory and permissive) and basic legal support surveillance activities of state public health. They will be able to perfect material for their examination in local council meetings, as well as perfect decision of Chief Sanitary Inspector concerning the application of fine, halting activities of respective enterprises, as well as the files on the presentation in contravention liability prosecution bodies or the courts.
