Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 The Three Cs Policy: Confidentiality, Counselling and Care POLICY FOR UN STAFF AND FAMILIES AFFECTED BY HIV AND AIDS IN KENYA The goal of the Three Cs Policy is to ensure confidentiality, counselling and care to all categories of UN staff members in order to create a healthy workforce. This includes access to anti-retroviral medicines in a reputable clinic that recognizes the physical, psychological and the social impact of HIV and AIDS.

Have you heard me today? Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 WHO IS ENTITLED? Internationally and locally recruited staff who subscribe to Van Breda. Locally recruited staff in the National Officer or General Service category who subscribe to the Medical Insurance Plan (MIP). All other UN staff members on contracts that do not fall into the above two categories.

Have you heard me today? Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 HOW IT WORKS A contract was signed with the high quality One Stop Clinic (OSC) at Aga Khan Hospital. The OSC offers an integrated service for Voluntary Counselling and Testing (VCT), care and counselling and access to drugs. Upon arrival, staff use coded ID cards given to them by the UNON Joint Medical Service (UNJMS), allowing them access to OSC.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 THE THE AGA KHAN ONE-STOP CLINIC The Aga Khan Hospitals integrated, multi- disciplinary, one-stop HIV/AIDS clinic offers: Counselling services. Doctor consultations under the guidance of a consultant physician on infectious diseases and HIV/AIDS. Dispensing of anti-retro viral medicines and other drugs for opportunistic infections by a specialist pharmacist. Dietary advice.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 THREE Cs: FINANCIAL IMPLICATIONS FOR UN INDIVIDUALS Internationally recruited UN staff covered by Van Breda: Cash payments are required up front (i.e. on a pay as you go basis), and are reimbursed through submission of medical claims to Van Breda. To guarantee confidentiality, prior administrative approval for submission of claim is not needed. Locally recruited staff covered by MIP: The services are provided 100 per cent free of charge to the staff member (i.e. no payment is required either in advance or at a later time). Invoices are sent directly by OSC to UNJMS in coded form (thus ensuring confidentiality). UNJMS informs UNON of accounts liability for each UN agency and UNON then invoices each UN agency. UN agencies claim back 80 per cent of the cost from MIP and charge 20 per cent of the cost to other budget lines.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 The UN in Kenyas FAIRPACK Policy GUARANTEED FAIR EMPLOYMENT PACKAGE The UN in Kenyas FAIRPACK Policy is a guaranteed fair employment package for contractor employees based on site at the UN Complex in Nairobi. The FAIRPACK policy was implemented in July 2003 to provide a health and welfare package that will boost the pay and conditions of staff employed by contractors working for the UN at Gigiri. The FAIRPACK policy specifically includes a provision for access to appropriate treatment for contractors employees suffering from HIV/AIDS.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 THE FAIRPACK POLICY: CONTRACTORS RESPONSIBILITIES Contractors whose employees work at least fifty percent of a standard work week at the UN Gigiri Complex must: Comply with the Kenya Conditions of Employment Act and other relevant statutory requirements. Ensure that in cases where an employee, and/or their officially recognized immediate family, determine through a medical test that (s)he suffers from HIV/AIDS, that employee is able to access and receive the appropriate treatment o (provided for a maximum of 5 children under the age of 21 years). Provide four months paid maternity leave, exclusive of annual leave entitlements.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 Enrol employees in a medical insurance scheme or enter into an agreement with a company doctor for outpatient and inpatient cover o (the limit of insurance coverage or treatment of the doctor depends upon the contractor/company but it should ensure that proper medical care is provided). Provide a guaranteed wage of at least KSH 6,000 (US $75 equivalent) per month, adjusted annually to inflation o (housing allowance and other allowances should be based on net pay). Provide a substantive and nutritious lunch through the services of a catering outlet or pay a lunch allowance of a minimum KSH 50.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 Provide a transport shuttle from/to city centre or/and from/to housing areas located near to the UN Gigiri Complex, whichever is most appropriate for the workers, or pay transport allowance. Provide safety and working equipment to the highest industry standards, including footwear, gloves, protective clothing for heavy machinery. Ensure that the FAIRPACK policy is implemented for the duration of the contract.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 THE THE FAIRPACK POLICY : UNONS RESPONSIBILITIES: Establish and implement an appropriate monitoring mechanism/system to ensure contractors are in compliance with the policy. Establish punitive measures in the contracts that will be applied should contractors be in default on the terms and conditions of the policy. Build clauses into tender documents to ensure all companies are aware of the policy prior to the submission of bids. Ensure the policy is attached as a page of all UNON contracts, and require contractors to sign an affirmation that legally binds them to follow the policy. Allow the terms of the policy to be adjusted by UNON on behalf of the UN agencies located at the UN Gigiri complex to reflect substantial changes in the law or in conditions (i.e. the minimum wage being statutorily increased) or other circumstances that may warrant an adjustment to the policy.

Women, Girls, HIV and AIDS WORLD AIDS DAY 2004 THE ROLE OF THE UN FAIRPACK MONITORING COMMITTEE: Act as a monitoring oversight mechanism for contracts awarded under the FAIRPACK policy. Act as a focal point, both for UN staff members and for contractors employees, for queries or complaints related to the implementation of the FAIRPACK policy. Make recommendations concerning the FAIRPACK policy to management. Be the guardians of the FAIRPACK policy. To not be at all concerned with the technical or substantive nature of the contractors activities.
