HB 104 School Planning and Zoning Compliance Sponsor: Rich CunninghamStatus: Held by House Political Subdivisions Committee Would remove many of the exceptions to local land use and zoning regulation currently held by schools Most provisions applied to both charter and public schools Charter schools would be an allowed use in any residential zone

HB 108 Mobile Home Park Task Force Sponsor: Tim CosgroveStatus: House - Passed Senate Committee – Favorable Recommendation Creates a legislative task force that will look at: Issues related to mobile home park removal. Relocation of residents. Dealing with abandoned mobile home parks.

HB 220 Land Use Amendments Sponsor: Gage Froerer Stewart AdamsStatus: Passed both Houses Clarifies the definition of land use authority. Provides that a recorded, amended plat vacates a previously recorded plat. Requires a municipality or county to justify why it would have a higher or stricter land use regulation that currently written in state code

HB 258 Municipal Business Licensing (first substitute) Sponsor: Jacob AndereggStatus: Stalled in Committee Prohibits a municipality form requiring a license for certain businesses. Authorizes a municipality to require certain businesses that are exempt from licensure to register with the municipality.(No fee or penalty and be assessed) Prohibits a municipality from transmitting information about certain businesses.

SB 196 Medical Waste Incinerators Sponsor: Todd WeilerStatus: Senate - Passed House – Business and Labor Committee Medical Waste Incineration would be prohibited within 2 miles of property zoned residential (as of January 1, 2014). Refined to incineration of infectious waste or chemotherapeutic agents. Grandfathers existing operations.

SB 51 Local Government Entities Amendment Sponsor: Jerry StevensonStatus: Passed Senate Would increase the number of TOD projects that UTA can partner on from 5 to 10.

SB 114 Canal Safety Act Sponsor: Gene DavisStatus: Senate – Passed House – Held by committee Requires canal owners to assess risk levels of each canal by 1/1/2015. Requires a remediation plan for all high risk canals that identify repairs and improvements necessary to reduce risk of failure. Plan must be approved by the Division of Water Resources. Prohibits DWR from providing a grant or loan for a canal that does not have an approved remediation plan.

SB 169 Public Meetings Materials Requirements Sponsor: Deidre HendersonStatus: Passed both Houses Defines “electronic information” – information presented or provided in an electronic format. Information related to an item on the agenda. Requires an individual who presents or provides electronic information at an open meeting to provide an electronic or hard copy of the information at a the time of the meeting.

SB 211 Water Rights Amendments Sponsor: Margaret DaytonStatus: Senate – Passed Second Reading Would remove municipalities protection from forfeiture. Strongly Opposed by ULCT-APA

SB 228 Geographic Diversity Amendments Sponsor: Stuart ReidStatus: Senate – Passed House - Introduced Changes the rules regarding referendums Signature number requirements from within majority of precincts.

HB 422 Initiative and Referendum Impact Disclosure Sponsor: Bradley LastStatus: House Committee – Favorable Recommendation Would allow a city to prepare an objective analysis about a citizen referenda and initiative and share the analysis with the public in an open meeting. The bill would allow a city to inform its voters about the referendum (consequences) but not to spend funds in opposition to the initiative or referenda.

SB 82 BillboardsSponsor: Margaret DaytonStatus: Senate Government Operations and Political Subdivisions Committee Legislative Leadership told the two sides to sit down and work it out. Prohibits a municipality or county from enacting or enforcing certain billboard ordinances relating to electronic or mechanical changeable message signs; Prohibits a municipality or county from commencing eminent domain proceedings to prevent a billboard owner from upgrading a billboard to an electronic or mechanical changeable message sign; Amends the definition of maintenance to include upgrading a sign for the purposes of outdoor advertising regulations; Amends provisions related to an electronic or mechanical changeable message sign;

SB 184 Local Government Inspection Amendments Sponsor: Stuart AdamsStatus: Senate – Passed House - Introduced A fee collected for the inspection of a construction project shall ensure prompt inspection. If the inspection cannot be completed within 3 business days, an independent inspector shall promptly be engaged.

SB 249 Transportation Rights-Of-Way Sponsor: Curtis BrambleStatus: Senate – Favorable Recommendation from Committee Expands the definition of "state transportation purposes," within transportation rights-of- way provisions, to include the construction and maintenance of pathways for pedestrians and other nonmotorized users. Latest effort to regain some eminent domain abilities for trails.
