 Why Change?

Past Limitations  Limited Intervention  Safety Fitness tied directly to Compliance Review  Focused largely on carriers  Limited number of investigators  The government regulates 725,000 bus and truck companies  Compliance Review was labor intensive  Only able to reach less than 2% of total carrier population annually

 The intention of CSA is to improve the efficiency and effectiveness of FMCSA’s enforcement and compliance program and to reduce commercial motor vehicle crashes and fatalities.

 CSA is based on roadside inspection violations  Will reach more carriers  Improve efficiency  Focus on specific unsafe behavior  Identify root causes  Requires corrective action

 3 Components I. Measuring Carrier Safety a) Roadside inspections-the program uses data retroactively for two years(carrier) and three years(driver) b) Investigation findings c) Crashes II. Intervention Process III. Safety Fitness Determination (SFD)

 SMS = Safety Measurement System I. Uses crash records II. Assigns weights to time and severity of violations based on crash risk III. Seven performance based categories IV. Triggers intervention

 New Agency Plans for Drivers...  Provide enhanced information on individual drivers  Enhance the effectiveness of investigators to conduct carrier investigations Under CSA, individual drivers WILL NOT be assigned safety ratings or fitness determinations.

 Carrier Access to Data  Carriers have access to full SMS results and BASIC measurements  Public has access to SMS results and BASIC measurements except for percentile scores for the Crash Indicator and Cargo- Related BASIC  Cargo-Related violations are available to the public  Decision regarding what to display was based on feedback through out the field test and data preview  List of crashes is available to the public  Similar to the Accident SEA in SafeStat

 Roadside Data Uniformity …does not exist!  Roadside data is the foundation of all data-driven traffic safety initiatives  CSA relies on roadside data  CSA SFD methodology uses roadside data as component of the safety fitness determinations

 4 Core Initiatives 1. Consistent documentation of roadside inspections 2. Standardized process for data review 3. Increased awareness of inspection program a) Good inspections can support systematic enforcement b) Screening vs. Inspection 4. Uniform inspection selection process

 Data Q’s …provides the public, including carriers and drivers, the opportunity to request a data review to ensure the accuracy of Federal and State- reported data.

 Helpful suggestions when requesting Data Q’s  Attach document(s) of support  Be specific and detailed  Include a lease agreement (if necessary)  Include accurate contact information  Check status frequently

 Intervention Tools Warning letters Investigations − Offsite Investigations − Onsite Focused Investigations − Onsite Comprehensive Investigations Follow-on corrective actions − Cooperative Safety Plan (CSP) − Notice of Violation (NOV) − Notice of Claim (NOC) − Operations Out-of-Service Order (OOS)

 Safety Fitness Determination (SFD)  On-road safety performance is updated monthly  Will continue to include major safety violations found by CSA investigators  Produce an SFD of  Unfit or  Marginal or  Continue Operation Draft is currently in review within USDOT. Notice of Public Rule Making expected to publish late 2011.

 Remember…  Safety Fitness Determination (SFD) has not been put into effect  Drivers will NOT be rated  At this time, ratings are based on investigation findings  Onsite Comprehensive Investigations can result in Satisfactory, Conditional, or Unsatisfactory ratings  Onsite Focused Investigations can results in Conditional or Unsatisfactory Ratings  Offsite Investigations do not result in rating  Carriers can request an administrative review of its safety rating (Part )

In Summary… CSA improves three main areas 1. Safety Measurement System  More comprehensive profile of carriers and drivers  Better able to pinpoint the source of safety problems  Better identifies high crash-risk behavior 2. Interventions process and tools  More efficient/effective enforcement and compliance process  Wider range of interventions to influence compliance earlier  Match intervention with level of safety performance 3. Proposed change in evaluation: SFD  Assess safety performance of larger segment of industry  Based on roadside performance and intervention results  Rating will be updated more often, conveying current safety condition

 Educate yourselves and your employees:  Understand the SMS Methodology and the BASICs  Check the website for information and updates (  Raise awareness that every inspection counts and every violation counts  Ensure compliance  Review inspections and violation history over the past two years  Log in to the SMS, review BASICs, and address safety problems now!  Educate drivers about how their performance impacts their own driving record and the safety measurement of the carrier  Check and update records  Motor Carrier Census (Form MCS -150)  Routinely monitor and review inspection and crash data  Question potentially incorrect data (DataQs:
