City of Bay Minette Title: Municipal Court Magistrate Department: Court Salary Range Exempt Worker’s Comp Summary The purpose of this classification is to exercise authority as assigned by law to issue warrants, accept pleas, receive and record fines, provide clerical support to the court, and perform other duties as mandated by applicable local, state, and federal law. Essential Functions The following duties are normal for this classification. The omission of specific duties does not exclude them from the classification if the work is similar, related or a logical assignment for this classification. Other duties may be required and assigned. Specific duties listed may not be required for all positions within this classification, but are determined by the normal requirements for the particular position. Swears in complaints and traffic citations; dates and records into court following established guidelines; approves surety bonds; makes determination for issuance of felony and/or misdemeanor warrants; writes, authorizes and issues warrants following procedures established by law; maintains log of all warrants issued. Hears case facts on citations issued by law enforcement agencies; conducts initial appearance proceedings for prisoners; sets bail in accordance with applicable laws and regulations; grants bail in minor misdemeanor prosecutions in accordance with discretionary bail schedule and approving property, cash, and professional surety bonds; accepts and records pleas into the court; determines fines based on standards established by state and/or local laws; receives money assessed for bonds, fines and forfeitures; records money received to the correct case number; issues receipts on fines received; enters payments into computer; dismisses cases; files documentation in a systematic manner to ensure ease of retrieval; forwards applicable documentation to other judicial and law enforcement agencies for notification purposes. Conducts initial appearance and sets non-guilty please for trial; opens court and calls the docket; grants continuances in municipal ordinance violation cases. 1

Maintains pre and post trial list of all city prisoners. Attends and testifies in court; prepares forms for use during courtroom proceedings; assures documentation is complete and accurate in accordance with all applicable laws, codes, and guidelines. Processes documentation on defendants for first appearance in court. Receives, records, reviews, composes, and approves legal records, documents, forms and requests; records, processes and forwards records to appropriate departments and agencies; ensures documents are filed and maintained for ease of retrieval and utilization by the court. Balances cash received against receipts daily; researches any errors detected and corrects accordingly; secures cash in department safe; prepares cash for deposit; complies, distributes, and maintains reports for analysis and use by the court. Gathers and analyzes statistical, financial, and narrative data; compiles data into comprehensive format for reporting to local and state judicial, law enforcement, and governmental agencies; reviews data to ensure information is complete and accurate; corrects any errors detected; distributes reports to appropriate personnel, departments, and other judicial or law enforcement agencies. Assists the public by providing information; researching court dates; advising procedures; directing to other departments and/or agencies. Answers telephone; directs calls to appropriate personnel and/or departments; takes and relays messages. Maintains a comprehensive, current knowledge and awareness of applicable laws/regulations; reads professional literature; attends workshops and training sessions. Trains new personnel on departmental procedures and regulations. Compiles payroll on assigned personnel; obtains appropriate review and approvals; forwards payroll for processing and disbursement. Provides clerical support to the staff of the department; maintains office equipment; photocopies and distributes documents. 2

Monitors office supplies to ensure adequate inventory is sufficient for daily operation of the department; orders supplies on a routine basis. Performs the suspension of driver’s licenses as required by state law; dismisses no driver’s license violations where the defendant shows proof of a driver’s license at the time of the citation was written; dismisses mandatory liability insurance violations where the defendant has produced satisfactory evidence that at the time of the citation the motor vehicle was covered by a liability insurance policy; dismisses equipment violations where a municipal ordinance allows and where the law enforcement officers signs Uniform Traffic Ticket and Complaint verifying that the equipment has been replaced. Recommends policies and procedures that guide and support the provision of quality services by the department. Incorporates continuous quality improvement principles in day to day activities. Must accomplish the essential functions of the job, with or without reasonable accommodations, in a timely manner. Must meet regular attendance requirements. Must be able to maintain good interpersonal relationships with staff, co-workers, managers and citizens. Performs other related duties as required. Serves as a Notary Public. Minimum Qualifications Bachelor’s degree in Criminal Justice or a related field with no previous experience, or a high school diploma or GED with four years of administrative experience in a judicial or legal environment, or any equivalent combination of education, experience, and/or training which provides the requisite knowledge, skills, and abilities for this job. Must become certified as a National Crime Information Center computer operator. Must obtain certification as a Municipal Court Magistrate within three years of employment. Must be eligible to be certified as a Notary Public. Must possess and maintain a valid Alabama driver’s license. Minimum Requirements to Perform Essential Job Functions The following requirements are normal for this classification. Specific requirements may not apply to all positions within this classification, but are determined by the normal requirements for the particular position. 3

PHYSICAL REQUIREMENTS: Must be able to operate a variety of automated office equipment including computer terminals and printers, calculators, photocopy equipment; fax machines, and paper cutting devices. Physical demand requirements are at the level of those for sedentary work. DATA COMPREHENSION: Requires the ability to compare and/or judge the readily observable functional, structural, or compositional characteristics (whether similar to or divergent from obvious stands) of data, people, or things which may include legal, procedural, and administrative information. INTERPERSONAL COMMUNICATIONS: Requires the ability to speak with and/or signal people to convey or exchange administrative and legal information, including giving/receiving assignments and/or directions to/from co-workers, assistants, managers or supervisors as well as communicating with judicial agencies, law enforcement personnel, and the general public. LANGUAGE ABILITY: Requires ability to read a variety of legal and administrative documentation, directions, instructions, methods and procedures. Requires the ability to write job related documentation and reports with proper format, punctuation, spelling and grammar, using all parts of speech, Requires the ability to speak with and before other with poise, voice control, and confidence using correct English and well-modulated voice. INTELLIGENCE: Requires the ability to learn and understand relatively basic principles and techniques to understand departmental policies and procedures, to make independent judgments in absence of supervision, and to acquire and be able to expound on knowledge of topics related to primary occupation. VERBAL APTITUDE: Requires the ability to record and deliver information, to explain procedures, and to follow verbal and written instructions. NUMERICAL APTITUDE: Require the ability to add, subtract, multiply and divide; calculate decimals and percentages; interpret statistical data and charts and perform statistical calculations. FORM/SPATIAL APTITUDE: Requires the ability to visually inspect items for proper length, width, and shape using job related equipment which may include computer terminals and printers, calculators, photocopy equipment; fax machines, and paper cutting machines. MOTOR COORDINATION: Requires the ability to coordinate hands and eyes in using office equipment. 4

MAUNUAL DEXTERITY: Requires the ability to handle a variety of items, automated office equipment, control knobs, switches, etc. Must have the ability to use one hand for twisting motion or turning motion while coordinating with other hand with different activities. Must have minimal levels of eye/hand/foot coordination. COLOR DIFFERENTIATION: May require the ability to discern color. INTERPERSONAL TEMPERAMENT: Requires the ability to deal with and relate to people beyond giving and receiving instructions. Must be able to adapt to and perform under minimal stress when confronted with an emergency. PHYSICAL COMMUNICATION: Require the ability to talk, express, or exchange ideas by means of spoken words and/or hear and perceive nature of sounds by ear. 5
