Update on Regulation of Residential Services for People with Disabilities (including children) DFI Seminar on Regulation and Keeping the Focus on Best Outcomes for People with Disabilities 28 May 2014 Niall Byrne Deputy Director of Regulation (Adult Social Care Services)

Regulatory Activity to date Type of Centre Announced Inspections Unannounced Inspections Total Inspections Total Number of Centres % Inspected to date Adults % Children % Both % Total % 7 centres registered to date. Expect 250 registered by end All 953 will be registered by 30 Oct In the meantime, they operate “as if” registered. There are 1,605 service “units” accommodating approximately 8,000 people.

Our evidence focus when inspecting Evidence that the provider organisation is governed in a “fit” manner Evidence that management staff are “fit persons” Evidence that staff are competent and properly supervised Evidence that services are appropriate, person centred, evidence-based & enabling of each person Evidence that assessments and care/service planning are conducted in partnership with each person using services Evidence that each person's rights are protected Evidence that each resident is safeguarded in a way that is as least restrictive as possible

Are people safe in this service? Are they protected through the actions of “fit” persons working within good governance structures? Is there a genuine focus on personal choice and person- directed services? Are people being supported to have meaningful life opportunities? Is there a focus on quality of service and quality of life? Is there evidence of values and convictions in action? “What is this like as a place to live?” and “What is life like for this person?” Can we trust this provider to comply with Regulations and Standards when we're not in the centre? Key questions underpinning our decisions

The purpose of regulation is twofold – to ensure people using services are safe and that services are improving over time HIQA will act in a fair, reasonable and proportionate manner where providers are clearly committed to the foregoing There will be timely, focused and rigorous enforcement response where providers show a lack of this commitment In summary then…
