Transportation: Accidents From Impairment Substance Abuse Alcohol was the most prevalent drug, found in 52% of vehicle accidents. Alcohol, marijuana, heroin, cocaine and amphetamines are responsible for most trucking accidents. Fatigue / sleep-deprivation Fatigue contributes to numerous accidents.

Transportation: Statistics Of randomly tested interstate tractor-trailer drivers: 15% had marijuana in their system Of all stopped reckless drivers w/o alcohol in their system: 45% had marijuana in their system (*) 25% had cocaine in their system Truck accidents: 30% caused by driver fatigue 13% of fatal accidents caused by drivers using marijuana. 12% had non-prescription stimulants (*) 3x marijuana detection in drivers prescreened for recklessness

Transportation: Liability In 2006, a Swift Transportation driver on meth was involved in a highway wreck with a Yellow Freight truck: $23.5 million verdict for one YF employee who suffered catastrophic spinal cord injury. A wrongful death trial is still pending for the other YF employee.

Transportation: “Direct Observation Rule” In May 2009, a court decision supported the US DOT requirement for transportation industry employers to implement the Direct Observation Rule for Return-to-Duty and Follow-up testing 73 Fed. Reg. 62,910, 62,918 Adulteration of urine samples collected for drug and alcohol screening has significantly increased among workers. Employees who elect not to participate in drug & alcohol screening shall be treated as a positive test and required to demonstrate that they are drug free before returning to work. √ ESP will help employers by providing solid, quantifiable, reasonable-suspicion indicators.

Substance Abuse Testing Exceeding minimum federal requirements is always beneficial. –Current testing procedures are invasive, slow and costly. –Testing can easily cost $100 per test. Employers struggle with reasonable cause for conducting targeted drug tests. –A reasonable-suspicion test could result in litigation. –Now “Direct Observation” is required. –Often supervisors “look the other way.” Laura Ruhl Genson, Anita Kerezman (Eds.)
