Recent Tennessee Hazardous Waste Regulatory Amendments In May 2010 the existing Tennessee hazardous waste fees were adjusted for inflation since the date that each individual fee was last revised. A few were adjusted past inflation. Some new fees were applied to commercial universal waste and used oil businesses and for certain regulatory reviews in order to help cover the cost of areas we regulate. The new fees became effective on May 17, 2010.

Federal Hazardous Waste Revisions Tennessee did not adopt the Expansion of the Comparable Fuels Rule and has delayed adoption consideration of the Revised Definition of Solid Waste Rule in RCRA Cluster XIX due to the current EPA review. Tennessee intends to adopt the Academic Laboratory Rule from RCRA Cluster XIX. Tennessee did adopt RCRA Cluster XVIII and intends to adopt RCRA Cluster XX without any substantial revisions.

Other Changes? In early 2010, Tennessee instituted a new inspection tracking system to better track our used oil and universal waste inspections. Tennessee has a new law, effective April 15, 2010, restricting the disposal of mercury-added consumer products in Subtitle D landfills effective January 1, On July 1, 2009, the legislature lifted restrictions in the Tennessee Code on the incorporation of federal regulations by reference. We may begin utilizing incorporation by reference. A new petroleum spill policy was implemented on April 23, 2010 which specified specific clean-up actions and requires a report to the Division of Solid Waste Management on the clean up.
