Invention An apparatus, method or composition of matter Defined (“claimed”) in a patent application as:  A combination of interconnected elements or  A combination of steps to be performed Examples:  Electronics, software, mechanics, image processing Patentability depends on novelty and non- obviousness of the structure, not the function, of the combination A patent application must teach how to make and use the invention Infringement: To make, use, sell, offer to sell or import a device that includes all elements recited in a claim, or a method that actually performs all steps recited in a claim
