House Bill 426 The agency shall adopt minimum standards for the operation of disciplinary alternative education programs. Not later than December 15, 2008, the agency shall deliver a report to the legislature that provides the estimated costs to the agency of enforcing the standards adopted under subsection (a-1), including the estimated cost of on-site monitoring to enforce the standards.

The commissioner shall: Adopt rules necessary to evaluate annually the performance of DAEPs Develop a process for evaluating DAEPs electronically Develop a system and standards for review of the evaluation

Educational and Self-discipline Alternative Instructional Program Elementary grades K-6 Junior and senior high grades 7-12 Students placed in or expelled to a DAEP under well-defined criteria that minimizes disproportionate and inappropriate placements Includes districts participating in Shared Service Arrangements (SSA)

District Improvement Plan Includes performance of the DAEP student group Objectives shall include: –Subgroups served –Attendance –Pre/post assessment results –Performance gains –Mandatory and discretionary placements –Number of students placed in a JJAEP after DAEP –Average length of stay –Academic progress –Dropouts –Graduation rates –Recidivism

DAEP On-campus or Off-campus Individual districts use sending school’s identification number Multiple districts through SSA with DAEP campus identification number for each district in the SSA Third party –Clearly state accountability standards –Grievance policy The campus of accountability shall remain the sending school.

School Day Minimum 7 hours, no more than 10 hours –Begin operation 1 hour before first scheduled class of sending school –Cease operation within 3 hours after last scheduled class 180 days

Attendance Rate Improvement plan developed when rate falls more than 5 percentage points below the rate for same grade level in the sending district Plan shall include –Parental involvement –Counseling –Examining factors for individual absences –Connecting families with community or social services –Utilizing truancy officer

Transportation Must be provided in accordance with TEC Chapter 34 to students when DAEP is located more than 10 miles from the student’s residence if the district provides transportation to sending school District may: –Utilize public transit systems (TEC ) –Allow transportation to sending school for limited purpose of coordinating transportation to DAEP District shall: –Not allow DAEP student to ride busses with non-DAEP students unless there is no safety/health risk to other students –Provide transportation regardless of hours of DAEP

Safety and Supervision Only qualified/certified teachers 15:1 student to teacher ratio Staff trained to respond to health issues and emergencies DAEP students under direct adult supervision at all times they are at the DAEP facility DAEP students separated from: –Students in JJAEP –Students not assigned to the DAEP –K-6 students from 7-12 DAEP students Students less than 6 years of age cannot be assigned to a DAEP unless mandatory expulsion for firearm DAEP shall establish a board approved policy for discipline and intervention

Education and Self Discipline Program Pre-assessment –Commissioner approved instrument –Includes assessment of basic skills of reading and math –Administered within 3 days of placement Post-assessment –Commissioner approved instrument –Administered to each student with 90 day or longer placement –Administered to each student who had multiple DAEP placements that, when combined, total 45 school days or longer Additional academic support –When students not performing at or above grade level based on pre-assessment –Individualized programs, tutoring, and other means available

DAEP Curriculum Grades K-6 –Core and elective subjects including PE –Self-discipline Grades 7-12 –Focus on ELA, math, science, history and self- discipline –Provide each student the opportunity to remain current in and pass all core and elective courses in which they are enrolled at time of assignment to the DAEP through any available method, including completing the course in the DAEP, correspondence or distance learning class, or summer school DAEP students shall be offered opportunity to complete current school year coursework before beginning of the next school year Textbooks and materials for both on-grade level and off-grade level and adapted to each student’s functional reading level

Instructional Program Delivered by teacher directed instruction Teacher directed instruction balanced with: –Instructional technology and computer- assisted instruction –Individualized attention –Regular coordination with sending school –Innovative and effective instructional strategies –Social and daily living skills instruction –Self-paced and individualized instruction –Challenging and appealing methodology –Flexible delivery –Any other means available to lead to the student performing at or above grade level and not remain a discipline problem

Graduation Plan DAEP staff shall obtain and/or develop the four-year graduation plan Develop a Personal Graduation Plan (TEC ) While in the DAEP, the plan shall be evaluated with the student and revised as necessary Student’s 4-year graduation plan cannot be changed “just because” the student is assigned to a DAEP

Students with Disabilities Continue participation in the general curriculum Continue to progress toward IEP goals established by ARD committee DAEP staff shall use positive behavioral interventions, appropriate special education discipline, instructional practices, supports, and other strategies prescribed by the ARD committee DAEP shall maintain ongoing coordination and participation with student’s ARD committee ARD committee shall be reconvened when adjustments to IEP are necessary

Guidance and Counseling Provided pursuant to TEC (a)(6) Shall include guidance and counseling, responsive services, and individual planning Using TEA’s AchieveTexas framework, ensure that DAEP students in grades 7-12 develop Texas Achievement Plans for job preparation and careers

DAEP Staff Training Managing student behavior Education and discipline for a student with a disability Treating all students with dignity and respect Discipline management systems Conflict resolution, anger management, social skill development, values, and good decision making Options to prevent and intervene in student discipline problems, including bullying, harassment, and making hit lists Instruction in social skills and problem solving Individualized instruction Methods to improve consistency and due process in the application of consequences Tools to help prevent recidivism Procedures on reporting abuse, neglect, or exploitation of students

Transition Transition shall begin the day the Placement Conference (TEC ) is conducted Continue as along as necessary until student is reintegrated into the regular program DAEP shall document who attended and date of Placement Conference and a summary of the conference (in student file) Obtain and analyze academic and discipline information for each student from sending school within 3 days of placement Orientation to DAEP Weekly progress report DAEP staff are encouraged to facilitate meetings with teachers from sending school Establish a transition protocol Evaluate annually the transition program
