2 DEFINITIONS OF “MIGRANT WORKER” IN INTERNATIONAL DOCUMENTS (1) DocumentDefinition of “migrant-worker” Migration for Employment Convention (Revised), 1949 (No. 97). Ratification: Armenia , Kyrgyzstan , Moldova , Tajikistan “The term migrant for employment means a person who migrates from one country to another with a view to being employed otherwise than on his own account and includes any person regularly admitted as a migrant for employment.” Migrant Workers (Supplementary Provisions) Convention, 1975 (No. 143 ILO). Convention concerning Migrations in Abusive Conditions and the Promotion of Equality of Opportunity and Treatment of Migrant Workers. Ratification: Armenia , Tajikistan – “The term migrant worker means a person who migrates or who has migrated from one country to another with a view to being employed otherwise than on his own account and includes any person regularly admitted as a migrant worker.” European Convention on the Legal Status of Migrant Workers, 1977 (ETS №093, Council of Europe). Ratification: Moldova , Ukraine – “The term “migrant worker” shall mean a national of a Contracting Party who has been authorised by another Contracting Party to reside in its territory in order to take up paid employment.” International Convention on the Protection of the Rights of all migrant Workers and Member of Their Families, 1990 (Resolution 45/158 General Assembly UN). Ratification: Azerbaijan , Kyrgyzstan , Tajikistan , Armenia - signature 2013, not ratification. “The term “migrant worker” refers to a person who is to be engaged or has been engaged in a remunerated activity in a State of which he or she is not a national.”

3 DEFINITIONS OF “MIGRANT WORKER” IN INTERNATIONAL DOCUMENTS (2) Recommendations on Statistics of International Migration, (№58 UN, 1998) Citizens departing to work abroad → Foreign migrant workers: foreigners admitted by the receiving State for the specific purpose of exercising an economic activity remunerated from within the receiving country. Their length of stay is usually restricted as is the type of employment they can hold. Their dependants, if admitted, are also included in this category.

4 DEFINITIONS OF “MIGRANT WORKER” IN CIS DOCUMENTS DocumentDefinition of «migrant-worker» Agreement of CIS member states on cooperation in the field of labor migration and social protection of migrant workers, 1994, amended and supplemented in Entered into force: Azerbaijan , Armenia , Belarus , Kazakhstan , Kyrgyzstan , Moldova , Russia , Tajikistan , Uzbekistan , Ukraine "Migrant worker (or employee) - a person permanently residing in the country (party) of departure, legally engaged in a remunerated activity in the country (party) of arrival.” Convention on the Legal Status of Migrant Workers and Members of Their Families of CIS Member States, Entered into force: Azerbaijan , Armenia , Belarus , Kazakhstan , Kyrgyzstan , Ukraine «Migrant worker - a person who is a national of one of the countries (parties), as well as persons without citizenship permanently legally residing on the territory of one of the parties and legally engaged in a remunerated activity in the territory of the other Party, where he is not a national and not permanently lives».

6 CIS-Stat proposals (1) Unified definition of "migrant worker" as a statistical unit for Migrant worker is a person who is to be engaged, is engaged or has been engaged in a remunerated activity in a State of which he is not a national The introduction of the definition of "migrant worker" in the practice of statistical measuring is not intended to replace the terms contained in national laws and regulations.

7 The criteria for registering "Migrant Workers" CIS-Stat proposals (2) + CITIZENSHIP ? ENGAGE in a remunerated activity (employment) engage in entrepreneurial activities ? LENGTH OF LIVING IN THE TERRITORY OF THE STATE WHERE THE WORK ACTIVITY IS CARRIED: Permanent residents (with a residence permit/permanent residence permit); Temporary residents (who are authorized temporary stay/ residence)
