2 What Does REAL ID Do?  911 Commission: Improve “system” to secure ID ● One vulnerable state increase risk to all other states  Sets minimum standards for state issued DL/IDs  Increases the security & integrity of “state- issued” DL/IDs  Make the nation stronger, safer & better protected against terrorism & identity theft  Protects individual privacy  Respects the authorities & functions of states  Increases confidence that people are who they say

3 What REAL ID is NOT!  Not a National ID ● States DL/IDs will vary per states choice ● States can also non-compliant DL/IDs  Not a Federal Data Base ● DHS will not have access to States DMV data  Not mandated for the states ● States can opt in or opt out  Not include an RFID or any other chip ● REAL ID compliance does not include RFID  Not including fingerprint, eye scan, etc.

4 REAL ID NPRM & Program Design  Comprehensive ● Covers broad spectrum of activities ● Broad scope ― 240 million individual, 56 jurisdictions, 5 Federal agencies ● No “silver bullet” ― security is the sum of many integrated activities & systems (“the devil is in the details”) ● Balancing the desirable with the possible  Few specifics (except card stock) ● Minimize Federal pre-emption of State authorities & functions ● Target requirements ― destination not roadmap ● Limited requirements for data verification & exchange  Compliance guidelines― both required & necessary ● Standards for Compliance Plans & Certification Packages― States ● Criteria for assessments, audits, & approvals― DHS ● Must be issued before States can submit Compliance Plan (extensions) or Certification Packages ● Must focus on Privacy Issues and concerns

9 Electronic Birth Record Verification  Facilitate EVVE connectivity ● DHS to provide separate grant ● Fund states for one-time purchase of EVVE-SI software To facilitate State vital records authority and state motor vehicle authority access to the EVVE hub. Funding will be provided to all applying states Up to 75K per state

10 REAL ID Program Milestones  May 10, 2005 ― REAL ID Act signed  December 2006 ― REAL ID Program Office stood up  March 1, 2007 ― Draft NPRM posted on DHS website  March 9–May 8, 2007 ― 60 day public comment period  April 12, 2007 ― DHS Webinar broadcast  March 16, 2007 ― Meet with Negotiated Rule members  March, 2007 – AMVA Roadshow  May 1, 2007 ― DHS Town Hall meeting in Sacramento  May 4, 2007 ― DHS Webinar with NCSL members

11 Program Milestones  Spring: Award Grant to complete EVVE implementation  Summer-Fall 2007 ● DHS announces award of competitive grants to States ● DHS Publishes Final Rule ● DHS Publishes Certification & Compliance Guidelines  October 1, 2007 ― Final date States may submit extension requests ● No supporting documentation required  October 2007–May 2008 ● DHS works with States seeking to meet May 11, 2008 compliance deadline ● DHS works with States & territories granted extensions to help prepare Compliance Plans

12 Proposed Program Milestones  May 2008–December 2009 ― Compliance Plans ● DHS monitors State progress toward compliance ● DHS works with States to ensure continued progress toward compliance  May 2008–December 2009 ― Certifications ● DHS works with states ready to file Certification Packages ● Additional States begin to issue REAL IDs ● DHS reviews certification updates & reports ● DHS conduct State audits as needed  January 1, 2010 ― All States begin to issue REAL IDs  May 11, 2013 ― Full compliance with REAL ID
