Inform industry of JSC’s anticipated acquisition approach for American Recovery and Reinvestment Act of 2009 (Recovery Act) - Cross Agency Support (CAS) funds. Promote competition and seek out firms interested in performing prime or subcontract roles on-site for any required services at NASA-JSC associated with Recovery Act - CAS funds. Notify firms of services anticipated to be performed at NASA- JSC, Ellington Field, Sonny Carter Training Facility in association with the Recovery Act – CAS Projects. Services to be performed primarily include general construction and roofing, electrical, mechanical and civil/structural disciplines. Communicate to industry the additional requirements for contract recipients of Recovery Act funds. Goals of Recovery Industry Day

However, written questions may be submitted following the presentation using the forms provided, and responses will be posted via the NASA Acquisition Internet Service (NAIS) website. Overview of the NASA Safety Program NASA safety objective is to avoid loss of life, personal injury and illness, property loss or damage, or environmental harm resulting from any of its activities and to ensure safety and healthful conditions for persons working at or visiting NASA facilities NASA complies with all applicable regulations NASA safety and health requirements Requirements of those federal agencies with regulatory authority over NASA such as OSHA, EPA, and DoT NASA requires every employee to report workplace hazards NASA ensures that there is no reprisal to personnel for reporting unsafe or unhealthy conditions

Overview of the NASA Safety Program The NASA Safety Policy stresses the individual responsibility of each employee for their own safety and that of their co-worker. Risk within the work environment must be managed to control hazards and continuously improve workplace conditions The Occupational Safety and Health Administration (OSHA) has recognized JSC as a leader in health and safety by awarding the “Star” designation level of achievement in the Voluntary Protection Program (VPP) As a VPP Star Site, JSC has a comprehensive and successful safety and health program, is below the national average for the industry in injury/illness rates, has demonstrated good faith in dealing with OSHA, and serves as a safety & health mentor to regional industry JSC has not experienced a construction related lost time case in 3 months (92 days 3/12/09) (4 years 52 days since the last lost time case)

What would be expected of you at JSC All contractors performing work at JSC shall comply with all applicable safety and health requirements Occupation Safety and Health Administration (OSHA) regulations JPR , JSC Safety and Health Handbook NASA , Contractor Safety and Health Program JSC does not assume the responsibility of the “employer” for contractor employees Contractor employer is responsible for the safety of its own employees Every onsite contractor shall have and conform to a written safety and health plan Failure to comply with safety and health requirements may result in actions such as contract termination and exclusion from future contract awards.

Safety & Health Plan Requirements Contractor’s Safety & Health Plan requirements are specified in NASA Requires the following S&H Plan submittals: Contractor's General Safety and Health Plan - describes the Contractor’s overall Safety and Health Program. This Plan shall be submitted with the proposal and approved prior to contract award. Contract (Site) Specific Safety and Health Plan - describes how the Contractor’s General Safety and Health Program will be tailored to the activities on this contract. This Plan shall be submitted and approved prior to work being started Subcontractor Safety and Health Plan - The Contractor shall submit detailed, written Subcontractor Safety and Health Plans. Subcontractor plans shall be approved prior to subcontractor work being started Minimum contents of each of the safety and health plans are listed in NASA

Security/Badging Requirements Special Instructions for Temporary Workers Who Require Access to the Johnson Space Center Special security/badging procedures have been established for temporary workers: The prime contractor shall provide to the JSC project manager/Contracting Officer Technical Representative (COTR), a list of all temporary workers who require access to the center less than six months. All temporary workers will enter JSC through gate 3 and shall check in daily with the security officers at the vehicle inspection checkpoint. All temporary employees shall be transported between the designated parking area and the construction site by a permanently badged, contract employee and shall be escorted at all times by a permanently badged contract employee while on the construction site. Anyone transporting or escorting foreign national workers on the installation must be a United States Citizen. Temporary employees will be required to remain within the designated construction area until the end of work. Details regarding access by Temporary Workers will be further defined in the solicitation documents.

Security/Badging Requirements for Foreign National Visitors and Employees/Representatives of Foreign Contractors (JSC (JAN 2006) An employee of a domestic Johnson Space Center (JSC) contractor or its subcontractor who is not a U.S. citizen (foreign national) may not be admitted to the JSC site for purposes of performing work without special arrangements. In addition, all employees or representatives of a foreign JSC contractor/subcontractor may not be admitted to the JSC site without special arrangements. Details regarding the admittance of Foreign National is further defined in the clause. Personal Identity Verification of Contractor Personnel (FAR ) (JAN 2006) The contractor shall comply with agency personal identity verification procedures identified in the contract and insert this clause in all subcontracts when the subcontractor is required to have physical access to a federally-controlled facility or access to a Federal Information system. Specifically, offerors should be aware that all U.S. Citizens requiring physical access greater than six months or IT access must be investigated. Foreign Nationals requiring physical access greater than 29 days must be investigated, those whose stay is less than 29 days will be issued escort required temporary badges. In order to obtain any type of JSC badge, individuals must present two types of I-9 Data, one of these must be a Federal or State issued picture identification. Further details will be provided in solicitation documents. Security/Badging Requirements

Recovery Industry Day Overview The purpose of Recovery Industry Day is to help industry understand the Government’s requirements and vision for the Recovery Act – CAS projects. All procurement actions conducted as part of the American Recovery and Reinvestment Act of 2009 (Recovery Act) dated February 17, 2009 will be subject to transparency and accountability so Americans know where their tax dollars are going and how they are being spent. Mechanisms through special contract terms and conditions will be implemented to accurately track, monitor and report on taxpayer funds. The Recovery Act requires data from the prime recipients of Federal funding. This may include special Buy American Act requirements, additional requirements for contractor reporting, and expanded Government Accountability Office (GAO) and Office of Inspector General (OIG) access to contractor records. Questions or Clarifications concerning the procurement of these projects may be submitted in writing on the forms provided at the conclusion of this presentation. Answers will be posted on the NASA Acquisition Internet Services (NAIS) website. A copy of this presentation and a list of attendees with contact information will be posted on the NAIS website.

Recovery Act Contractor Reporting Requirements Reporting is required for all recovery act funds. Contractors receiving recovery funds shall, not later than ten days after the end of each calendar quarter, submit a report to the Contracting Officer that contains: (1) total amount of recovery funds received (2) amount of recovery funds received for each project or activity (3) a detailed list of all projects or activities for which recovery funds were received, including: (A) the name of the project or activity (B) a description of the project or activity (C) the completion status of the project or activity (D) an estimate of the number of jobs created and the number of jobs retained by the project or activity

Recovery Act Contractor Reporting Requirements (4) Detailed information on all first tier subcontracts to include: (A) Name of the subcontractor (B) Amount of the award (C) Date of award (D) The applicable North American Industry Classification System code (E) Funding agency or agencies (F) Award title descriptive of the purpose of the action (G) Subcontract number (H) Subcontractor location including address (I) Subcontract primary performance location including address (J) Unique identifier for the subcontractor Aggregate reporting by the Contractor is permitted on awards below $25,000 or awards to individuals The first quarterly report is due on July 10, 2009

Recovery Act – CAS Project Overview Cross Agency Support (CAS) Projects consist of restoration and mitigation of NASA owned infrastructure and facilities related to the consequences of hurricanes, floods, and other natural disasters that occurred in 2008 for which the President declared a major disaster under title IV of the Robert T. Stafford Disaster Relief and Emergency Assistance Act of Specific JSC CAS Projects have been identified as: Roofing Packages Complete roof replacement and loggia ledge replacement of multiple facilities at the Johnson Space Center and Ellington Field identified as Roof Packages 1 and 2. Other Work Packages Additional work packages are anticipated to include one roof project, one carpet replacement project and approximately six general construction type projects. The following charts provide the anticipated content and schedule for each of the CAS Project Work Packages.

Recovery Act – CAS Project Overview The subject procurements will be conducted in accordance with Procurement Information Circular (PIC) 08-03, under the Small Business Competitiveness Demonstration Program (SBCDP) and FAR Part 19. The SBCDP requires NASA to use full and open competition for all construction solicitations when the anticipated award value exceeds the emerging small business (ESB) reserve amount of $25,000 and the annual agency review determines that the center has achieved the required percentage of dollar awards to small businesses in construction. However, per FAR Part 19, these acquisitions must continue to be considered for placement under the 8(a), HUBZone and Service-Disabled Veteran-Owned Small Business Procurement Program.

Estimated Schedule – Roof Packages 1 and 2 Synopsis3/2009 Invitation for Bid3/2009 Pre-Bid Conference and Site Visit4/2009 Bid Opening4/2009 Contract Award5/2009 A more detailed procurement schedule will be posted on the NAIS website as soon as it is available.

Each Roof Package will be conducted as a separate stand-alone acquisition. The NAICS Code and small business size standard for these procurements are Roofing Contractors $14M respectively. It is anticipated that each Roof Package will be conducted per FAR Part 14, Sealed Bidding through issuance of an Invitation for Bid (IFB) and resulting contracts will be Firm Fixed Price Construction. Solicitations/IFBs have not been developed for these packages. Each package will be assigned a unique solicitation number and will be posted on NAIS. A pre-bid conference and site visit will be conducted approximately one week after release of the solicitation. Details for attendance will be included in the IFB. Recovery Act – Other Work Packages Based on review of the scopes of work for Other Work Packages a determination was made that these projects are appropriate for set-aside to 8(a), HUBZone or SDVOSB as per the SBCDP and FAR Part 19. As per the Small Business authorized contracting programs, it is anticipated that direct awards will be made to firms determined capable of performing as the prime contractor. Capability briefings are currently being conducted for the work identified for small business set-asides. Estimated period of performance for Other Work Packages ranges from 120 to 365 days.
