2009 Statewide Local Issuance Training Death Record Corrections and Amendments

Death Record Corrections Minnesota Rules, part , subpart 2 Within 45 Days and Before Issuance Informant or entity that filed record may request an amendment Correction is limited to corrections and provision of missing information

Death Record Amendments Minnesota Rules, part , subpart 1 Amending After 45 days OR Issuance Requesting an Amendment Any one can request an amendment Choose one of the following options: – funeral director, informant, local or state registrar Refer requests for amendment to cause of death to the state registrar.

Death Record Amendments Minnesota Rules, part , subpart 3 Amending After 45 days OR Issuance Amending through the Funeral Establishment Must be within 1 year of the date of death Informant must give written approval to the amendment Registrar amends record upon receipt of written request from the funeral establishment

Death Record Amendments Minnesota Rules, part , subpart 4 Amending After 45 days OR Issuance Amending through the Informant Must be within the first year after death Must present to the registrar a notarized statement to amend Statement must state: –I am the informant named on the original documentation of death; –The requested amendment is accurate; and –I agree to the requested amendment.

Death Record Amendments Minnesota Rules, part , subpart 5 Amending After 45 days OR Issuance Amending through a local registrar Must be within five years of date of death Must use the application to amend Amendments limited to name, date of death, place of death, date of birth, parentage, spouses name, maiden name, marital status, SSN or sex Must present acceptable documentation

Death Record Amendments Minnesota Rules, part , subpart 5, item B Amending After 45 days OR Issuance Acceptable documents: Birth record Marriage certificate Divorce decree Legal description of the place of death as recorded with the county recorder Social Security Number (SSN) history from SSA Notarized statement from a person who was present at the death (date and place of death) Court order that instructs a registrar to make the requested change

Death Record Amendments Minnesota Rules, part , subparts 5 and 6 Amending After 45 days OR Issuance Refer to the state registrar if: More than five years have elapsed from the date of death The requested amendment is to items other than name, date of death, place of death, date of birth, parentage, spouses name, maiden name, marital status, SSN or sex The person requesting amendment can not provide acceptable documentation The item to be amended has been previously amended
