Objectives:  Review the procedures required to be followed by the aerodrome operators and regulatory authority staff for granting exemptions from non-compliances with National Aerodrome Standards for Certification of Aerodromes. Module -84 D10. EXEMPTIONS / WAIVERS: D10.1 The Authority or Director General may exempt, in writing an Aerodrome Operator from complying with all or any provisions/requirements of this ANO for the reasons recorded separately. Such exemptions/waivers shall be granted on case to case basis, subject to such conditions relating to safety/other related matters as may be specified. D10.2 As mentioned above, an exemption will be subject to the Aerodrome Operator’s complying with the conditions and procedures specified by the Authority or Director General and as deemed necessary in the interest of safety. Module -85 D10. EXEMPTIONS / WAIVERS: D10.3Where an aerodrome does not meet the standards specified in Aerodrome Standards Manual of Pakistan, the Authority or Director General may determine after carrying out aeronautical studies, the conditions and procedures that are necessary to ensure a level of safety equivalent to the established standards. D10.4Any exemption granted by the Authority or Director General shall be included in the relevant part of Aerodrome Manual. D10.5The Authority has the right to exempt all or any aerodrome from any issue pertaining to safety and aerodrome certification subject to the conditions that operator has satisfied and given a timeline to remove the deficiencies for which exemption has been sought.  The Aerodrome Standards Manual of Pakistan sets out requirements for the aerodromes design and operations in Pakistan.  At an existing aerodrome where the standards set forth in ASMP are not complied with, must be identified and exemption from the DG CAA Pakistan may be sought by the certificate holders with submission of his plan or timescale to bring the facility in compliance with the standards.  The plan and timescale shall be recorded in the aerodrome manual after the approval of DG CAA Pakistan. 1.INTRODUCTION An Aerodrome Certificate Holder is expected to comply with the requirements laid down in the Aerodrome Standards Manual of Pakistan. October 15Module -88

CAA Pakistan to have procedures for accepting cases for non-compliance in respect of an aerodrome being issued with a certifiate in the following situations:  There may be some circumstances where compliance of requirement have not been followed at an existing aerodrome:  because of physical constraints; and  where the facility had been provided earlier as per old standards and continued to be in operation.  Where compliance is not possible also for a new aerodrome due to physical constraints. Exemption Procedures for Non-compliance at Aerodromes 2.Purpose  To harmonise the procedure for certification of aerodromes which do not conform to some of the specifications contained in the ASMP on Aerodrome Design and Operations Standard and are required to be complied for certification of aerodrome.  The ultimate goal is to require the non- compliances to be corrected and to deal with the situations where this is not possible, either due to physical constraints like terrain etc., October 15Module -810

Exemption Procedures for Non-compliance at Aerodromes 4.Procedure for Seeking Exemptions 4.1The aerodrome operator shall submit separate application for each non-compliance in the prescribed proforma for seeking exemption. 4.2 The application for exemption shall be supported with:  the reasons for noncompliance;  safety assessment reports;  means of mitigation; and  indication as to when compliance can be expected. 4.Procedure for Seeking Exemptions 4.3 The applicant should provide adequate information in the prescribed proforma for consideration for granting exemptions with supporting documents. Failure to provide adequate information may delay processing / refusal of the application. 4.4 The Director General after examining the applications for exemptions may exempt, in writing, an aerodrome operator from complying with specific provisions of the ASMP and may impose conditions for such exemptions to ensure the safety and regularity of aircraft operation. 4.5 On approval of the exemption, it shall be included in the aerodrome manual and in AIP. 4.6 On removal of the exemption the certificate holder shall notify the same to the DG, CAAP and after approval of DG, the same shall be deleted from Aerodrome manual and AIP. 4.7 The exemption granted shall be reviewed during renewal of the aerodrome certificate.
