3 Regulatory Process Information regarding the regulatory process can be found at the Independent Regulatory Review Commission (IRRC) website and select The Regulatory Review Process in Pennsylvania

4 Why ODP is Revising Regulations ODP is committed to providing individuals with the everyday life of their choosing, including access to quality, needed services and supports.

5 ODP intends to rewrite 55 Pa Code, Chapters 2380, 2390, 6400, and The Regulations for Revision

6 Assure the health and safety of individuals. Ensure a minimum quality standard for services and supports provided to individuals and their families. Reflect best practices and future direction of service delivery options. New regulations will…

7 Comprehensive Regulation Revisons Focus on regulating services instead of buildings. Expand language regarding quality expectations for services. Emphasize consistent standards (where possible) for regulated services and supports.

8 Plan Regulation Amendments The current regulatory amendments to Chapters 2380, 2390, 6400, and 6500 regarding planning will continue to move forward. These revisions will be incorporated into the new regulations.

15 Comprehensive Regulatory Revision Process The process began November  Reviewed previous regulatory review initiatives  Researched other states regulatory language and structure  Conducted Internal evaluation of present regulatory language  Established 5 year plan to promulgate regulations

16 Where the process is at now… Nominations are now being accepted. Workgroups are scheduled to occur from June October 2009

17 Workgroup Composition ODP intends to develop every workgroup with a minimum of 51% representation from individuals and families

18 Time Commitment Workgroups are to run consecutively from June 2008 to October 2009 Each workgroup will meet for approximately 3 months Meetings will consist of at least 2-3 face to face or video conferences

19 Work Commitment Read and revise multiple sections of regulation text Review and comment on draft proposed regulations Actively participate in discussions (video, on- site, or ) to discuss draft proposed regulatory language
