Presentation transcript:

IPR in the biodiversity information and natural history domain Boris Jacob (MRAC), Cecilia Buffery (RBGK)

/ Sharing information via BioCASe with...  Europeana  Global Biodiversity Information Facility (GBIF)  Others  BioCASe Network  Natural History Aggregator  Different Intellectual Property (IP) practices and implications in science and culture.

/ Layers of information according to Europeana

/ Content (layer #1, #2, #3) and metadata (layer #4)  Metadata  Textual information (including hyperlinks) that may serve to identify, discover, interpret and/or manage Content.  Content  A physical or digital object that is part of Europe’s cultural and/or scientific heritage, typically held by the Data Provider or by a data provider of the Data Provider. Europeana Data Exchange Agreement pp. 2/11

/ Content and Metadata in Europeana

/ Content and Metadata licensing  (Meta)data  All textual (meta)data provided via the BioCASe provider software is under the terms of the Creative Commons Zero Public Domain Dedication (CC0 waiver).  Content  All other content, such as previews, soundbits, and the content referenced by URI (web addresses) in the metadata do not fall under the CC0 waiver and remain completely under the control of the Content Provider. Europeana Data Exchange Agreement

/ Europeana Licensing Framework  Data Exchange Agreement (DEA)  CC0 copyright waiver  Europeana Data Use Guidelines  Terms for User Contributions  The edm:rights field of the Europeana Data Model.

/ Creative Commons Zero (CC0)  Designed for Data  Re-use of data is free from all restrictions  Copyright and similar rights waived  In jurisdictions where copyright cannot be waived, provides a condition-free licence.  In jurisdictions where such a licence would be invalid, asserts that rights holder will not exercise rights  Commercial use permitted  Citation not required

/ IPR implications of joining OpenUp!  Decide on which license you want to apply to your content.  Give data into the public domain (CC0).  Sign the OpenUp! Data Access Agreement (DAA) > Full version and restricted version. Later replaced by the MoU.  Sign the Europeana Data Exchange Agreement (DEA)

/ What users (you, me, everyone) can do  Re-use of content according to the providers license  No limit on data re-use (API, Mash-ups).  Europeana Use Guidelines  Attribution strongly recommended but not a formal licensing condition  Acknowledge modifications Europeana usage guidelines for Metadata, pg. 1  Europeana search with licensing filter.

/ Tricky Considerations  Non Commercial  What does this actually mean?  Unintended consequences  Attribution  Different cultures, different emphasis  Burdensome (stacking)  Policing adherence to licence terms?

/ GBIF Data Use Agreement  “In order to make attribution of use for owners of the data possible, the identifier of ownership of data must be retained with every data record.”  “Users must publicly acknowledge, in conjunction with the use of the data, the Data Publishers whose biodiversity data they have used. Data Publishers may require additional attribution of specific collections within their institution.”  “Users must comply with additional terms and conditions of use set by the Data Publisher. Where these exist they will be available through the metadata associated with the data.”

/ Further information  OpenUp! article:   Europeana Licensing Framework  4c82a-f76c-4f4f-b8a7-600d2168a73d 4c82a-f76c-4f4f-b8a7-600d2168a73d
