DIVERSITY AND EQUALITY IN CONTRACTS

Z DIVISION – CENTRAL SERVICES Property Fleet Supplies IT Liaison

EQUALITY IN CONTRACTS Lothian and Borders Police remains fully committed to delivering diversity and equality as the highest priority within the normal flow of all of our work. We expect to play our full part in creating a society that is at ease with its component parts and that has the full trust and confidence in the police service that protects and cares for it. We shall promote a holistic approach to the maturing equality agenda and support the ultimate aim of a more tolerant and cohesive society. Our new equality scheme will endeavour to better engage with the minority communities to earn their trust by demonstrating a convincing set of long-term outcomes that meet their individual needs. Chief Constable

WHAT THE LAW SAYS Under UK legislation, local authorities must consider equal opportunities in their contracts. We encourage all our suppliers to introduce appropriate equal opportunities policies and procedures. The key equality legislation includes: -The Race Relations Act The Race Relations (Amendment) Act The Sex Discrimination Act The Sex Discrimination (Gender Reassignment) Regulations 1999 – amended The EC race directive – EC Directive 2000/43/EC -Local Government (Scotland) Acts – 1973, 1986 & Local Government in Scotland Act 2003

WHAT THE LAW SAYS (CONTINUED) –The Disability Discrimination Act 1995 –The Equal Pay Act 1970 –The Sex Discrimination Act 1975 –The Employment Equality (Religion or Belief) Regulations 2003 –The Employment Equality (Sexual Orientation) Regulations 2003 –The Employment Equality (Age) Regulations 2006 –The Gender Equality Duty 2007 –The Gender Recognition Act 2004 –The Human Right Act 1998

PRE-CONTRACT - PROCUREMENT LBP promotes Diversity and Equality in the tender process: In evaluating tenders we will look for suppliers who can demonstrate that they understand their responsibilities and operate with due regard to the legislation.

PRE-CONTRACT - PROCUREMENT (CONTINUED) Tender Questionnaire: A questionnaire is issued as part of the Tender documentation. Extracts from the questions are shown below: Q) Is it your practice not to discriminate directly or indirectly on grounds of colour, race, nationality or ethnic or national origin, disability, gender, religion or belief, sexual orientation or age in relation to decisions to recruit, select, remunerate, train, transfer and promote employees? Q) Is it your policy as an employer to comply with your statutory obligations under the Sex Discrimination Act 1975, as amended, the Sex Discrimination (Gender Reassignment) Regulations 1999, the Equal Pay Act 1970, and the Disability Discrimination Act 1995 – all of which apply in Great Britain – or equivalent legislation in the countries in which you employ staff?

FINALLY I am Diversity Champion for Police Headquarters I am Deputy Chair of the Forces LGB&T Support Group Under the Employment Equality (Sexual Orientation) Regulations 2003, employers are legally required to tackle homophobia in the workplace. Supporting an LGB&T staff network is a good way for employers to show their commitment to tackling homophobia. Stonewall AND Lothian and Borders Police recognises and supports Lesbian, Gay, Bi-sexual AND Transgender – please do not forget the T word!!
