3 Contractor Support to Deployed Forces Contractor support falls into three broad categories (JP 4-0, Chapter V) Systems Support –Logistical support deployed with operational forces under pre-arranged contracts awarded by Service program managers –Support specific systems throughout systems life cycle External Theater Support –Provides support for deployed operational forces working pursuant to contracts awarded under the command and procurement authority of supporting HQs outside the theater –May be US or third party vendors –Examples include Army’s LOGCAP (Logistics Civil Augmentation Program), Air Force’s AFCAP (Air Force Civil Augmentation Program), Navy’s CONCAP (Construction Capability) Theater Support –Provides support to deployed operational forces pursuant to contracts arranged within mission area of responsibility, or contracts awarded through Host Nation –Contractors provide goods, services and minor construction usually from local vendor base

4 ACQUISITION PLANNING Contract Clauses The following clauses shall be incorporated into contracts when deployment of contractors is anticipated: FAR , Worker’s Compensation Insurance (Defense Base Act) FAR , Worker’s Compensation and War Hazard Insurance Overseas DFARS , Reimbursement for War Hazard Losses DFARS , Capture and Detention DFARS , Antiterrorism/Force Protection Policy for Defense Contractors Outside the United States DFARS , Disclosure of Ownership or Control by the Government of a Terrorist Country

7 ACQUISITION PLANNING INTERNATIONAL AGREEMENTS (IA) Status of Forces Agreements (SOFA) –Agreement with the most impact on contract support to U.S. Forces Other pertinent agreements –Mutual Defense Treaties –Agreements that require/allow pre-positioning of material –Mutual Logistics Support Agreements –Host Nation Support Agreements –Base Access Agreements Department of Defense Foreign Clearance Guide (DoD G) (DoD FCG) –Provides necessary information for personnel travel to foreign countries and general information on foreign locations –Applies to contractor personnel in direct support of a DoD contract –DoD must ensure all personnel clearance requirements are fulfilled prior to commencement of travel by contractor –DoD FCG is not releasable outside the US Government

8 ACQUISITION PLANNING POLICY AND GUIDANCE Department of Defense (DoD) Guidance –Joint Publication 4-0, Doctrine for Logistics Support of Joint Operations, 6 Apr 00, Chapter V, Contractors in the Theater Sets forth doctrine on the use of U.S. contractors in theater and provides a framework for addressing contractor support issues –DODI , 6 Nov 90, Continuation of Essential DoD Contractor Services During Crises Prescribes procedures to provide reasonable assurance of the continuation of essential services provided by DoD contractors –DODI , 14 Apr 00, Immunization of Other Than U.S. Forces (OTUSF) for Biological Warfare Defense Implements policy, assigns responsibilities and prescribes procedures against validated biological warfare threats –OSD/DPAP, 8 Dec 03, Inclusion of Defense Base Act Clause in DoD Overseas Contracts Mandates required clause be included in appropriate contracts

9 ACQUISITION PLANNING POLICY AND GUIDANCE Department of Labor (DOL) Guidance –Division of Longshore and Harbor Workers' Compensation (DLHWC) Provides information on the Defense Base Act (DBA) Air Force Guidance –Secretary of the Air Force Interim Policy Memorandum, 8 Feb 01, Contractors in the Theater Provides consistent and uniform policy on the use of US contractor personnel to augment the support of AF ops in wartime/contingency operations –AF General Counsel Guidance Document, Nov 03, Deploying with Contractors: Contracting Considerations Addresses practical aspects of contracting when performance requires contractor employees to deploy –Anthrax/Small Pox Vaccinations, SAF/AQC website provides implementing instructions for the vaccination of contractor employees against anthrax and smallpox –AFPC/DPS Message, 8 Apr 03, Geneva Conventions Identification Requires contracting officers ensure contractor personnel deploying overseas are aware of the need to have Geneva Convention Identification

10 ACQUISITION PLANNING POLICY AND GUIDANCE AFMC Guidance –"Contractor Support in the Theater of Operations" Deskbook Supplement, 28 Mar 01 Provides references, checklists and offers suggestions on generic contract language (excellent source of information prepared by all of the services) –Planning for Contractor Performance on Overseas Air Force Installations and Pacific Air Force Bases within the Territorial U.S. Addresses considerations/responsibilities involved in planning for contractor performance on overseas AF installations in the USAFE area of responsibility and PACAF area of responsibility –PACAF and USAFE Points of Contact –Checklists Planning for Contractor Performance OCONUS Air Force Installations – Contractor Support in the Theater of Operations – AFMC CONTRACTOR DEPLOYMENT WEBSITE

11 ACQUISITION PLANNING Field activities SHALL contact and coordinate performance with the CAO and installation commander/Contracting Squadron Commander BEFORE contract award (DFARS ) – Contract file MUST include documentation from the AF installation indicating the availability of the support and/or services provided by the installation. (AFMCFARS and AFMCFARS ) –Prior to contractor arrival, confirm advance notifications are provided to AF installation and all contractor requirements are being met REFER TO FOLLOWING WEBSITE FOR PLANNING CONSIDERATION, POINTS OF CONTACT AND CHECKLIST: BOTTOM LINE: COORDINATION IS ESSENTIAL!!!!

12 WAY AHEAD Proposed DFARS Case 2003-D087, Contractors Accompanying a Force Deployed –Provides uniform treatment of contractors who accompany a deployed force, as requested by USD(AT&L) and GAO –Case currently undergoing review by DAR manager Forthcoming AFMC policy letter providing additional guidance in the area of contractor deployment Improve AFMC contractor deployment toolkit –Provide additional links to International Agreements and other mutual agreements, pertinent clauses, etc. –Allow contractor access to toolkit
