PARTICIPATION IN NIRB REVIEW 3 TC is a Responsible Minister for the Nunavut Impact Review Board (NIRB) Part 5 environmental assessment because several project components and activities are within the Department’s mandate. TC provided specialist information and expert advice to NIRB through written submissions and technical meetings.

TRANSPORT CANADA MANDATE 4 Seeks to promote an integrated transportation system that is safe, secure, efficient, and environmentally responsible. Responsible for transportation regulations, policies and programs. Regulates associated transportation infrastructure, equipment and personnel in accordance with the legislation and regulations within TC’s mandate.

TRANSPORT CANADA LEGISLATION 5 Key relevant pieces of TC legislation include: -Navigation Protection Act (NPA) -Aeronautics Act -Canada Shipping Act, 2001 (CSA 2001) -Arctic Waters Pollution Prevention Act (AWPPA) -Marine Liability Act (MLA) -Marine Transportation Security Act (MTSA) -Transportation of Dangerous Goods Act (TDGA).

1. NAVIGATION PROTECTION ACT 8 TC made recommendation to AREVA, to submit information to TC to determine the navigability of Andrew Lake and potential applicability the NPA to project components. AREVA has committed to submit applications for approval under the NPA when final design details for project components, such as dykes, water intakes, temporary works, and outfalls that are listed in the Schedule of the NPA and other waters that may potentially be considered navigable.

2. MARINE SAFETY AND SECURITY TC made recommendation that AREVA submit an Oil Pollution Emergency Plan/Oil Pollution Prevention Plan (OPEP/OPPP) for the planned Oil Handling Facilities (OHF) prior to commencement of the Project. AREVA has committed to provide a revised Marine Shipping Plan (MSP) prior to licensing. The MSP will contain an OPEP/OPPP that conforms to regulatory requirements for operation of the OHF. AREVA Proposed T & C: Prior to facility licensing, AREVA will finalize the OPEP/OPPP for the Baker Lake dock site Oil Handling Facility that is compliant with Part 8 of the Canada Shipping Act and other relevant guidance documents. 9

2. MARINE SAFETY AND SECURITY TC made recommendation that AREVA provide TC Marine Safety and Security with specific vessel interfaces as soon as available, in accordance with the Marine Transportation Security Regulations. AREVA has committed to provide TC Marine Safety and Security with specific vessel interfaces at the time of Project licensing. AREVA Proposed T & C: AREVA will require that marine vessel operators comply with the Marine Transportation Security Act and Regulations. 10

3. TRANSPORTATION OF DANGEROUS GOODS 11 The Canadian Nuclear Safety Commission (CNSC) and TC have regulatory frameworks in place for the transportation of radioactive materials. AREVA will have to comply with the Transportation of Dangerous Goods Regulations and the Packaging and Transport of Nuclear Substances Regulations. TC made clarification recommendations to AREVA with regard to the transport of dangerous goods pursuant to the TDG Act and Regulations. AREVA agreed with all recommendations.

4. EMERGENCY RESPONSE ASSISTANCE PLAN 12 An ERAP is a plan that describes what is to be done in the event of a transportation accident involving certain higher risk dangerous goods. An ERAP is required by the Transportation of Dangerous Goods Regulations. In Nunavut, AREVA’s current ERAP # applies only to the transport of geological samples. AREVA will be required to update its ERAP to include yellowcake prior to the first shipment, and have the updated ERAP approved by TC.

CLOSING REMARKS TC will continue to work with AREVA and other interested parties throughout the ongoing stages of this environmental assessment process. TC looks forward to continued dialogue and cooperation with all stakeholders, including the Proponent, to ensure TC’s areas of jurisdiction are addressed. 13
