Evaluation & Reevaluation

How do you and your staff determine whether to waive reevaluation?

Do you allow consecutive waivers for the same student?

What can you do if you do not get permission to evaluate? reevaluate?

What are the four exceptions to the timeline for evaluation or reevaluation? 60 calendar days

School term begins on the first staff day of the fall term and ends with the last staff day of the spring term. What does this mean in regard to timelines?

Why must a student with an IEP from out-of-state be evaluated?

Is reevaluation required when amount of support is increased? Is it required when amount of support is decreased?

Review of existing data begins the reevaluation process. The Permission to Reevaluate form is not required if additional data are not needed.

An IEP meeting must be convened within 30 calendar days of the Evaluation or Reevaluation Report. If a student was previously evaluated and determined not to be eligible for special education, for a future request for evaluation the Permission to Evaluate is required.

An evaluation or reevaluation request can be denied by the LEA, BUT a NOREP must be issued. Reevaluation cannot be waived for a student with intellectual disability.

Consent is required for FBA as part of an initial evaluation. Permission to reevaluate is required if additional data are needed to conduct an FBA..

Screening for instructional purposes is not evaluation and therefore does not require consent. Screening or early intervening activities do not serve as a bar to the right of a parent to request an evaluation at any time including prior to or during the conduct of early intervening activities.

When determining SLD, 2 of the 8 factors that must be ruled out as a primary reason for lack of achievement are: visual, hearing, or motor disability; and intellectual disability. When determining SLD, 2 of the 8 factors that must be ruled out as a primary reason for lack of achievement are: emotional disturbance and cultural factors.

When determining SLD, 2 of the 8 factors that must be ruled out as a primary reason for lack of achievement are: lack of appropriate instruction and lack of appropriate instruction in math.

Consent is required when additional data are needed. School psychologist is a required member of the evaluation team when evaluating a child for autism, ED, ID, MD, OHI, SLD, or TBI.

In PA, if a request for evaluation is made orally, the LEA must provide a copy of the Permission to Evaluate Request Form to the parents within 10 calendar days of the oral request. The Reevaluation Report documents the review of existing evaluation data that is done by the IEP team during reevaluation.

The ER or RR must be presented to the parent(s) within the 60 calendar days timeline.
