Issue BSSD expands the concept of what an outside worker is –Now “Category B” (non-classified) as well as “Category A” (classified) –Now applies to work in supervised areas, not just controlled areas How UK implements this expansion of scope requires careful consideration

Examples of specific issues HSE believes that IRR99 implements the requirements for current outside workers HSE is less clear on whether the Category B outside workers requirements are clearly implemented, for example: –Appropriate training / working instructions –PPE –Overall Training

Next steps HSE will be undertaking a review of IRR99 requirements to draw out a comprehensive understanding of how IRR99 implements requirements for both BSSD categories of outside workers

Understanding current arrangements How do dutyholders take account of non- classified workers who work in their supervised and controlled areas?

Category B Outside Workers HSE believes that the current requirements for outside workers are well understood HSE is considering using a term other than “outside worker” to implement the BSSD requirements for Category B outside worker

Category B Outside Worker questions Do you share HSE’s view? If new regulations used terms such as “classified outside worker” and “non- classified outside worker”, would this cause confusion regarding what would be required for the different outside workers? Would the introduction in new regulations of a new class of outside worker (non- classified) be more confusing to employers and employees?
