Palestinian Environmental law No. 7 (1999) من أهداف القانون : 1. حماية البيئة من التلوث بكافة صوره وأشكاله المختلفة. 2. حماية الصحة العامة والرفاه الاجتماعي. 3. إدخال أسس حماية البيئة في خطط التنمية الاقتصادية والاجتماعية وتشجيع التنمية المستدامة للمصادر الحيوية بما يراعي حق الأجيال القادمة. 4. الحفاظ على التنوع البيولوجي وحماية المناطق ذات الحساسية البيئية وتحسين المناطق التي تضررت من الناحية البيئية. 5. تشجيع جمع ونشر المعلومات البيئية المختلفة وزيادة الوعي الجماهيري بمشاكل البيئة.

Palestinian Environmental law No. 7 (1999) الفصل الخامس حماية الطبيعة والمناطق الأثرية والتاريخية مادة (40) تقوم الوزارة بالتنسيق مع الجهات المختصة بوضع أسس ومعايير المحافظة على المحميات الطبيعية والمتنزهات الوطنية ومراقبتها والإعلان عنها وإنشاء وتحديد المتنزهات الوطنية ومراقبتها. المادة (41) يحظر صيد أو قتل أو إمساك الطيور و الحيوانات البرية والبحرية والأسماك المحددة باللائحة التنفيذية لهذا القانون، ويحظر حيازة هذه الطيور والحيوانات أو نقلها أو التجوال بها أو بيعها أو عرضها للبيع حية أو ميتة كما يحظر إتلاف أوكارها أو إعدام بيضها. المادة (42) تحدد الوزارة بالتنسيق مع الجهات المختصة الشروط اللازمة للمحافظة على التنوع الحيوي في فلسطين.

Palestinian Environmental law No. 7 (1999) الفصل الخامس حماية الطبيعة والمناطق الأثرية والتاريخية المادة (43) تتولى الوزارة بالتنسيق مع الجهات المختصة وضع الأسس والمعايير الكفيلة بتحديد النباتات والأشجار الحرجيه والبرية التي تمنع قطفها أو حصدها أو إتلافها أو قطعها منعاً مؤقتاً أو مستديماً بما يضمن بقائها أو استمرارها. مادة (44) يحظر على أي شخص القيام بأي أعمال أو تصرفات أو أنشطة تؤدي إلى الإضرار بالمحميات الطبيعية أو المناطق الحرجية أو المتنزهات العامة أو المواقع الأثرية والتاريخية أو المساس بالمستوى الجمالي لهذه المناطق.

Defined Biological diversity as: the variability among living organisms from all sources including terrestrial, marine and other aquatic ecosystems and the ecological complexes of which they are part; this includes diversity within species, between species and of ecosystems Signed by 150 government leaders at the 1992 Rio Recognizes that biological diversity is about more than plants, animals and micro organisms and their ecosystems It is about people and our need for food security, medicines, fresh air and water, shelter, and a clean and healthy environment in which to live Convention on Biological Diversity

Article 1 - Objectives The objectives of this Convention: – the conservation of biological diversity, – the sustainable use of its components – the fair and equitable sharing of the benefits arising out of the utilization of genetic resources by: appropriate access to genetic resources appropriate transfer of relevant technologies, appropriate funding. صيانة التنوع البيولوجي و استخدام عناصره على نحو قابل للاستدامة والتقاسم العادل والمنصف للمنافع الناشئة عن استخدام الموارد الجينية بطرق ملائمة ونقل التكنولوجيا الملائمة ذات الصلة مع مراعاة

Obligations Each Contracting Party shall, in accordance with its particular conditions and capabilities: – Develop national strategies, plans or programs for the conservation and sustainable use of biological diversity or adapt for this purpose existing strategies, plans or programs which shall reflect the measures set out in this Convention – Integrate, as far as possible and as appropriate, the conservation and sustainable use of biological diversity into relevant sectoral or cross-sectoral plans, programs and policies

Cartagena Protocol on Bio-safety بروتوكول قرطاجنة بشأن السلامة الأحيائية التابع للإتفاقية المتعلقة بالتنوع البيولوجي الهدف من هذا البروتوكول هو المساهمة في ضمان مستوى ملائم من الحماية في مجال أمان نقل ، ومناولة وإستخدام الكائنات الحية المحورة الناشئة عن التكنولوجيا الأحيائية الحديثة التي يمكن أن تترتب عليها آثار ضارة على حفظ واستدامة استخدام التنوع البيولوجي ، مع مراعاة المخاطر على صحة الإنسان أيضاً ، ومع التركيز بصفة خاصة على النقل عبر الحدود. The Cartagena Protocol on Biosafety to the Convention on Biological Diversity is an international agreement which aims to ensure the safe handling, transport and use of living modified organisms (LMOs) resulting from modern biotechnology that may have adverse effects on biological diversity, taking also into account risks to human health. It was adopted on 29 January 2000 and entered into force on 11 September 2003

General Provisions 1.Each Party shall take necessary and appropriate legal, administrative and other measures to implement its obligations under this Protocol. 2.The Parties shall ensure that the development, handling, transport, use, transfer and release of any living modified organisms are undertaken in a manner that prevents or reduces the risks to biological diversity, taking also into account risks to human health. 3.Nothing in this Protocol shall affect in any way the sovereignty of States over their territorial sea established in accordance with international law, 4.Nothing in this Protocol shall be interpreted as restricting the right of a Party to take action that is more protective of the conservation and sustainable use of biological diversity 5.The Parties are encouraged to take into account, as appropriate, available expertise, instruments and work undertaken in international forums with competence in the area of risks to human health.
